New SBA Contract

Yea like all the other promises we hear from these unions. PBA told us wed go back to tier 2 when I got on as one of the first tier 3 classes. That 50/50 and increase take home pay would be reinstated for tier 3. That Tier 3 would get 3/4 back, meanwhile Im paying 1% of my paycheck to make sure I Im protected for 3/4. Unions told us the bwc were only there to protect us and could never hurt us. SBA said we only had to watch 5 BWC videos a month. SBA said we only had to activate the BWC for certain jobs. The AVLs on rmps were only there as a safety precaution, and could never hurt us. We could go on and on and on. Unions say what they want you to hear. Cops are now making more than their supervisors. Meanwhile everyone is running for the hills to retire, resign, MTA, Nassau, Suffolk etc. and this job keeps wondering why people leave. Meanwhile they send out emails begging us to have our friends and family sign up for the city police test. What a joke.

Its really going to become an issue next August when PBA members are at 109,000 base and making more than every single SGT on the current pay Steps still making 96,000 base, Its honestly so embarrassing for the Union that they cant figure out how to fix this.

If the contract is ratified (which it will only take a majority vote to do) there is no recourse. Meaning you cant file a grievance or lawsuit, the union majority agreed to the terms. The only chance to fix the pay steps is in the contract negotiations now.

I am honestly shocked they put Sgt promoted after 8/1/2023 to top pay. If guys on the new list promoted prior to 8/1/2023 would have deferred, they could be making top pay now too!

If the majority of Sgts are step 5 we can pretty much agree that they will all vote yes as they have all done on all prior contracts. The cycle will always repeat itself when it doesn't affect the majority.

Why say that when it's simply not true and wasn't in the past. People who got promoted in the past started at step one only to have people promoted later go to top pay making more then them and get retro.

Right now we have the first 4 classes at step 5. They won't be going to top pay and then we have PO who went to Bmoc this week and are going straight to top Pay... Even added bonus the Detectives who go in with them aren't going to top pay.

None of that is going to get sorted out. It hasn't in the past and won't now. The step you are placed in is what will stay.

why why why why is the SBA so quiet on all this?

You have top pay SGT's in rank for 5+ years - making the same as 1 week old SGT's...
You have former DET's promoted and making less than 1 week old SGT's...
You have top pay PO's making more that SGT's with 1-4 years in rank...

Am I hallucinating re-reading this. Or is this real life?

This is why you never settle before the PBA because when you do, this is exactly what happens And now it is going to be an issue and I dont how it is settled for us. Its insane to think that If your stuck on this current pay chart once they finalize and top pay is around 160,000 that you basically go from 105,000 at step 5 to 160,000 top pay lol. I would assume maybe what they could do is simply adjust you into the new steps wherever you fall like for example if your at Step 2 96,000 and the new Step 2 is say 115,000 for example that they adjust you to that rate, But I dont know if that has ever been done before In the past.

Is there anyone in the forum that could shed some light on if thats been done on previous contracts.

I think you will come out ahead on your situation. Hopefully a nice retro, but guess we will see.

I still can't grasp PO and Detectvies going to same Bmoc and and PO going to last step and Detectives going to step before and staying there for 5 years. Makes no sense

IF this is truly the case, the DET  set for promo should highly consider writing a 49 to personnel requesting a demotion to PO. I think they're on probation 2 or 3 years anyway...

You guys make no sense.

Being upset about POs having a higher top pay than you is 100% legitimate complaint, one that will be rectified just like it was before.

Crying because another Sgt hit top pay before is a waste of time, you should be happy for them getting over on the city. How does that affect you? You knew exactly what your pay was when you took the position.

Im not upset that others are getting over on the city, I would do the same thing if I could It just annoys me that in this Situation you can have over a year in rank and as of right now make less than every PBA member and all new SBA members with no time in rank. And the unknown of if they will correct it. I have spoke to several members of the SBA delegation and none of them have offered a clear answer to how this will be fixed. And I know that Email the SBA sent out about deferring promotion def did not give an impression that the SBA was confident it would be rectified. Thats what most SGT in my position are upset about.

Detectives with 5 yrs in rank or more in the current BMOC Class are at top pay. POs with 5.5 yrs on or more are also at top pay. If you are a PO with less than 5.5 yrs on your step 5 sgt pay; same as if your a detective with less than 5 yrs in rank your at step 5 sgt pay.

You keep saying that but it wasn't before. Many sgt who got promoted early in the list 2 test ago had to go through all the steps, while others who got promoted after jumped to top pay while people before them never got thede till they hit the 5th year.

I don't see how you think it's ok and are justifying Det. and PO going into the same Bmoc and PO going to top pay and Det. not.  You keep saying that will be worked out and it 100% won't.

Blue71898 is 100% right. This needs to get worked out and the Vibe the Union is giving is that its not going in a good direction.

how can you have SGT with almost 3 Years in rank as the lowest Paid Personnel on the Job lol Its embarrassing.

Not sure what you don't understand about people being upset

If you were promoted this week you are top pay. If you were promoted last month you are NOT top pay and will never be until you complete your 5 years. That won't just work it self out unless someone steps in and it's not likley at this point. You are the step you are.

People take promotion to make more money, not to be told they were better off if they did score as high or that they didn't work hard to become detectivd

lol you guys are sensitive, I NEVER said the situation doesnt suck. I went thru all my steps for top pay, so yes, how the hell is a rookie making the same as me..

My point is, an official email was sent by SBA, forecasting this EXACT situation happening, and even advising that you should defer your rank.

And what happened? People still took the rank....majority of people still wouldve taken the rank, even if it was explained to them in person.

Im merely pointing out that all of us as a whole are quick to blame everyone but ourselves. As Ive already stated before, all this anger still is going to result in 80%+ yes votes..meanwhile all your coworkers in command are going to look at you in your eyes and say they voted no.

Yes but you also said it would work it self out, it's not always the case and thexpast has proven that.

with that said i'm hearing the POs aren't going to top pay. Not sure who told them that (instructor, union ??)but somone I know called and said thats not true. Guess time will tell

Dont know where you got your information but this was confirmed by a supervisor from Labor Relations after getting confirmation by city payroll. Also verified by a SBA Trustee.

Labor relations told the class they are going to top pay but the numbers dont back it up.

Top pay POs currently 105,106 I believe and Sgt Step 5 is 105,606, so I dont see any reason for guys to skip step 5 into top pay..maybe someone else has insight into it but I got those numbers from labor relations documents.

SBA confirmed they go to top pay. Maybe there are extra differentials for PO that I am not aware of that brings them over the 105,600.

if you call labor relations they confirm current PO go to top pay and Detectives don't. I don't know what's changed since last month that this would ahppen

The reason for the bump is the Current biweekly pay:
PO: 4033, longevity of 296 , neighborhood of 91 = 4420
Step 5 Sgt: 4050, longevity of 200 = 4250

You cant get promoted and get a smaller check than you were getting. So new sgts going to top pay just as it has happened before. Its a legal contract issue, is what it is

They sent out an email. Why would they tell BMOC ppl anything different? SBA is trying to work out the disparity in pay of those recently promoted. The % are agreed upon, nothing will change with that. Now its a matter of city budging on $$ & its $112k for recent classes thanks to the %s or get us over $118k So no one sues.

Any update from the emergency meeting yesterday?

So apparently the meeting yesterday nothing changed just that they dont want 12 Hour Tours and they are trying to fix the pay disparity. Unfortunately I heard a rumor they want to wait until December to settle that way the new contract % kicks in and all new SGT will get a 10% bump from the 96,000 base to 105,000 and the SBA can say were all up to date as of right now.
Hopefully not true but I could see them doing it like that and just stalling to not look bad so I hope someone else here heard something similar? Ive had multiple delegates tell me they will not change someones pay chart once your promoted so I just dont see them adjusting all new SGT.

It could be real I was hearing a couple months back that the LBA had agreed to 12 Hours and supposedly was told they would essentially have 2 LT per 12 Hour Tour but that could be fake info as well. This could be fake but I could see something like this happening. Either way until the SBA settles nothing will get done. Hoping someone else heard the same rumor I posted earlier ir something that contradicts it.

Taketheday, I believe that rumor is false. 1) I have been getting updates from an SBA Director and that isn't something that he has mentioned. 2) that still would not fix the pay disparity between newly promoted Sgts after 8/1/2023 who are making $118k or the Sgts promoted between the PBA ratification and before 8/1/23 who are making $105k. 3) the SBAs latest update via email is they gave the city a proposal to fix the disparity and the city is reviewing the proposal.

I believe they will fix the disparity, but one rumor I have heard multiple times and believe COULD be true is the city will fix the disparity but not pay retro on the pay steps (meaning only pay retro on the yearly salary percentage increases).

Thanks for the info, To be honest I would be totally fine with that and take whatever retro the % they give us. Thats very similar to what they just did with the PBA where they bumped the starting Salary for all PBA members with no retro coming from that bump. I think most if not all SBA members in the same situation would be fine with that scenario as well.

Any idea on the timeline of when they think they will reach an agreement

I havent heard anything about a timeline. I do not think they know because they are probably waiting on the city to review and respond to the SBA proposal. Its probably going to be a last minute thing, we hear about an emergency meeting, then next day press release.

With the 2021 PBA raise, PO's make more than any Sgt who wasnt top pay at the moment. Thus, everyone in that scenario needs to be jumped to the next step, and retro needs to be paid.

There is no other scenario that is acceptable. Youre talking about $20-60k in retro just on the disparity alone, not even counting the % increases.

This was stated at the SBA meeting on Thursday. No retro for pay disparity, this is not going to change. The only retro we are getting is going to be on the percentage increases. I don't know why your SBA rep would fail to mention that part of the meeting. If people don't like it, vote out the current SBA administration.

They have to pay its civil service law. You cannot make less after a civil service promotion. This will be fixed or there will be a lawsuit

Let me make this very clear, so everyone understands. If you dont believe me, CALL THE SBA HQ. Educate yourself.

1) If the SBA ratifies a contract (and all it takes is a majority vote) - WE CANNOT FILE A LAWSUIT.

2) There is NO law that says we have to make more (if there is, please post it, because the SBA said there is not a law). Since theres no law, the only thing we could file a lawsuit for is a violation of past practices. The past practice has always been you get a raise at your time of promotion, which we all did. What happens after does not matter and becomes a contract issue.

So our only hope is to settle the pay disparity is with a new contract, otherwise we are all s**t out of luck. So call or email the SBA now and advocate for yourself and your fellow Sgts. Theyre are 1200 Sergeants who could potentially be screwed if they fail to fix this disparity. Call and voice your opinion now. Do not be a sheep.

Sorry typo, I corrected it. Its over 1200 that are currently at the various steps below the $105k step that the disparity affects.

Please, call or Email the SBA and voice your concerns or ask questions (youll see the info above is accurate). If you wait until a unfavorable contract is presented, it will be too late, 1200 is not enough to vote it down.

Fact: SBA members who voted against the contract can sue the SBA, not the city.

With the 2021 PBA raise, PO's make more than any Sgt who wasnt top pay at the moment. Thus, everyone in that scenario needs to be jumped to the next step, and retro needs to be paid.

There is no other scenario that is acceptable. Youre talking about $20-60k in retro just on the disparity alone, not even counting the % increases.

This is what happens when the SBA settles before the PBA. The PBA got % raises and they also got an increase for starting pay their bump was NOT Retroactive only the % increase was. So if thats what the SBA has in mind we will not be getting retro for that.
