Sue SBA for what? Lol

Disparity is already being corrected. Its cheaper for city to correct disparity than paying top pay every new class, spending money on lawyers will be complete waste of money

How is it being corrected when we are not receiving retro on the pay disparity? Every month a new class goes in and they all go to top pay. That means that every other sergeant not at top pay is getting screwed. That is another month of us losing money while others get to go to top pay.

Fuck the SBA, I hope we can sue the shit out of them and the city and vote Vallelong and the rest of the board out of office.

The poster mentioned "fixing the disparity" which very different from receiving retro from the disparity. If we don't start separating the two terms, I guarantee you that the headline of the next SBA email will read "TOP PAY DISPARITY CORRECTED" and the union will sell it as problem solved.

The city will no doubt for a fact, increase base salary to be couple hundred dollars more that top pay PO. They have no choice. That will fix the "disparity".

The SBA is in no way negotiating being paid retroactively for the disparity.

All that being said, this board was officially "voted" into office in May 2022, as they ran unopposed. next election will be in 2026, and you must be a delegate for a year to run. So by mid 2024, everyone needs to get on the same page and get a group together to oppose the current board.

This is just how the contracts lined up. Same thing will happen if the PBA ratifies a NEW contract before the DEA because the DEA is IN contract for 2 more years over the PBA. pay disparity is the cost of doing business, some effected, most are not

2000+ SGT are affected by this, its literally half the Rank

I get what youre saying, Except it shouldnt be the cost of doing business. The fact that our unions allow the city to keep all ranks out of contract for years (up to 7!) is unacceptable. If all ranks were up to date on contracts, disparities such as this wouldnt happen. Taylor Law serves a purpose, but Im sure it wasnt intended to allow municipalities to keep public servants out of contract for egregious periods of time.

As of today, its been 223 days since the Pba reached a contract settlement. The limp SBA has done nothing to remedy this issue. I hit top pay very soon and if anything it further enrages me that nearly half the membership is impacted by this. Not only did the current board sell out the unborn by adding a year to top pay, but this past contract set us back a few years. I dont know how/why the current crop of delegates didnt challenge the board, the days of letting these guys spend entire careers on the board need to come to an end.

Someone promoted in 96 has no clue of the current issues. Someone whos never done an EOT recap has no idea. Someone who has never texted the CO a major because texting wasnt invented yet has no idea, someone who has never had to go over on CW4 has no idea.

The uncle contacts the Sba fairly frequently and I will say that this is the first time the SBA board is catching shit from the troops. They arent taking it well because they were left unbothered for the last two decades. In fairness to the membership, they all should have resigned, but as awful politicians do, they think they are above the common constituent.

With pending doom in city hall, I day buckle up folks.

Fraternally,

The Unc

Does anyone on this forum know a practicing labor lawyer in New York State? I have some questions. I know I have said many times once the contract has been settled we CANNOT file a lawsuit. However, this is getting ridiculous. The job keeps adding rookie Sgts making $22k more than us, our
subordinates make more than us, and there is nothing positive coming from the SBA showing signs that the city is willing to fix it.

I would like talk to a labor attorney to see if we have a case to file a lawsuit RIGHT NOW against the city before it is too late.

Call the union.
I call every effing week. I laughed at the moron I spoke with last week. They know the uncle down there already and pass me to the highest ranking Shlub there. Please call them. Make them earn that extra 20/40/60 percent. Theres two meetings this week and Im sure they are to hand out Sba cards and to try and get folks to donate 50 bucks for the raffle.
The current position is super concerning, they are not in the drivers seat. Im embarrassed to be a part of this union.

If we dont call or challenge them, we have no one to blame. The Sba is awful. Please call them. Do not bother with your delegate because they are also awful. Go right to the top.

Unc, Im trying to understand your case. I think with your theory, i can sue for being hired in 2007 for the 25k entry pay into the academy.  Where is my pay disparity with the rest of us hired.

Imagine doing that while having another position at the command. Now your doing patrol daily and be on top of your other gig (Dv, Traffic, Crime analysis. etc) because we so fucking short. All for #96k.

Care to explain? How did they lose that right

We are still in negotiations, unless we ratify a contract, we can still file a lawsuit. I have read actual contracts, not just the email the unions send out. Part of signing the contract is waiving all grievances and any lawsuits regarding the pending contract. I think its time we filed a lawsuit against the city.

Sector7. Not that Im against the lawsuit to happen or downplaying the whole thing, but I really do encourage you to get it started. You need to have people participate with you and get a small group to retain a lawyer. Most importantly, You need people who are suffering the same financial loss (97K/year) as you are. Start messaging people, get a list together and hit em hard.

Email I sent the SBA leadership. Don't forget here are their emails. Make your opinion heard! They are screwing us out of money every month that they wait! Every class goes to top pay, we are stuck at our pay AND WILL NOT RECEIVE RETRO MONEY ON IT!

75 newly promoted sergeants, all going straight to top pay! Over 50% of the union is stuck at 97K! Where is our contract? Why do new sergeants keep getting promoted and going to top pay and all of you are forgetting that the ones making 97K a year make up a majority of membership? Every month that passes we are stuck at our same pay rate, while newly promoted sergeants are at top pay. Why has this contract not been settled? The longer you wait, the longer most of us are missing out on money that we are not going to receive retro pay on. If you cannot get us retro pay on the money we have been losing since August, then why is this contract being dragged out? WE have the most to lose, we are not at top pay and we will not be getting retro pay for waiting.

MAKE YOUR VOICES HEARD!!!!! HERE IS OUR SBA LEADERSHIP WITH ALL THEIR EMAILS ATTACHED. WE ARE GOING TO MISS OUT ON $10,000-$47,000 OF MONEY THAT SHOULD BE IN YOUR POCKET BECAUSE THIS UNION DOES NOT WANT TO FIGHT FOR YOU!

Im now thinking, when The union said, for every new Sgt that gets promoted WE gain leverage, they meant the board gains leverage, NOT the rest of the membership. New sergeants at top pay, plus the ones already at top pay, will not vote down a new contract. Theyre playing the numbers game, and its not to OUR benefit. The only possible agreement I see as a win, is all current members being elevated to top pay under the new contact, thats the only way to make up for POs making more.

A wise man once said Its my money, and I need it now!

We are better off calling, the lovely women that answer the phone are a hoot.
Dont worry, big Vin seemed confident we gottem right where we want them. Clowns.

The play is to get them out and send them packing, the Pba waited 6 years and Patty only left because he wouldnt have finished his term. Vinny has 10 plus years to go, may as well prep to get these mooks out now.

Fraternally,
The uncle

And if anyone thinks the reason these losers are so quiet and arent fighting hard or as vocal as Ed, is for any other reason than they know theyre just as dirty or guilty, I have a bridge with your name all over it.

Here are the details from the SBA meeting today,

NO CONTRACT UPDATE! The SBA is meeting with the city at 1630 hours, hopefully there will be more information at tomorrow's meeting. I highly doubt we make any movement on the contract two days before Thanksgiving but hopefully I am wrong. Vallelong and the gang were very upset that someone recorded the last meeting. Hopefully someone recorded this meeting too!!!

Happened to the PBA right before they settled, people were tired of waiting. Well now Sergeants are tired of making less than POs and newly promoted Sergeants.

If you are reading this SBA Board Members, it is very simple on how to stop the recordings - DO YOUR DAMN JOBS AND START MAKING NOISE UNTIL THIS THING GET SETTLED FAST! YOUR ELECTED SPOTS DEPEND ON IT!

Another shitty email send from the SBA. Talk about pay disparity but NOT pay retro for all those sergeants getting fucked having cops make more than them for years. Sba wants to wait and benefit all members and not just those turds who wanted to score above a 90 on their sergeant exam. I remember when they wanted to hold out only to settle on the SAME EXACT contract all other unions settled for, except having the unborn wait an additional year to top pay. Great job you numb nuts in the office with your 30+ years who never did a DIR or had a cellphone on patrol. All you
Delegates sitting on ur thrones, stand up and follow the order of Japanese seppuku.

Dear Fellow Sergeant,

Yesterday we had another contract meeting with the City and progress was made. The City understands our concerns and the importance of working on the issues before we are able to present a complete contract to the membership.

The salary steps must be corrected, as there is no other police department where a frontline supervisor makes less money than their subordinates. As we have said before, the disparity in pay that exists between top pay Police Officers and a newly promoted Sergeant needs to be corrected.

The City has voiced its concerns regarding getting this issue resolved in a timely manner. The City is still considering the valuations of our proposals and asked us to consider some modifications.

We are in the process of working on submitting some variations that we can both agree on. We understand your concerns about getting this contract ratified, but as a union we cant just cant accept what is offered unless it benefits everyone.

Please remember that this contract will ultimately be voted on by the entire membership.

Thank you for your continued support. We will keep you updated on all developments and best wishes for a Happy Thanksgiving
