First off,  If you don't like how I mod you can leave.  I can't please everyone but I try to be fair.  I could of deleted every post from plaintiffs and I didn't delete any unless requested by someone that was offended. So yeah, I think I'm more then fair and have been Doing a service for free for 5 years

Just some quick thoughts. I wanted to put all of this behind us, don't understand why the plaintiffs are still bashing the interveners. That said:

1) The plaintiffs made completely spurious accusations of "bathroom whispers" against those who passed the exam on April 18.
2) The plaintiffs successfully froze promotions for deserving people who were supposed to be promoted, essentially stealing money from them.
3) Both complaints the plaintiffs submitted asked to have the exam invalidated, putting over 200 careers at risk of complete derailment.
4) Nothing in the intervener's filed papers said anything about preventing questions from being changed. Their only intentions were to protect the list and get promotions started again.

I'm glad people who came close to passing this very difficult exam will now be on the list, but any malice towards the interveners is completely unjustified and misdirected. People who passed on April 18 had a right to protect the list, they studied very hard, did not cheat, and were being severely affected by the plaintiff's accusations. They agreed to a settlement that strongly benefited the plaintiffs, what's the problem?

But now there are so many vacancies, the rest of us will get promoted when we should've been promoted anyways...

Yeah, Sarg, it wasn't only makeup testers who were getting in. Approximately 15 of the interveners had their promotions cancelled.

 

Does the end justify the means? Maybe for some, but the point is this bashing of people who were just trying to protect their rightly earned promotion is childish and completely full of lies.

 

The plaintiffs screwed over the interveners, the interveners didn't screw the plaintiffs.

Devil dog is on the money and I posted something similar a while back.  If they simply would have done a basic article 78 attempting to strike questions there would not have been animosity.  instead, we have to hear about ghosts whispering in the bathroom.  

Dont get me wrong, I'm very happy for many of my friends on here that will get added to the list.  I'm also happy that for the most part the makeup scamming is over.  Plaintiffs did achieve this.... But the ends do not justify the means.  They could of accomplished these goals without putting the list in jeopardy and suggesting that original test takers cheated.  

Finally, keep in mind if the interveners didnt intervene the list would still be in limbo.  The city would of never settled without interveners approval. Essentially, interveners created an environment for negotiation and for those that scored between a 65 and 69 to pick up points. The nine probably dont want to admit but that is 100 percent accurate.

So Bigfoot you are basically saying that everything got resolved because you both worked toward a common goal. Isn't this a better narrative to move forward with instead of hanging on to the bathroom whispers nonsense and bashing these guys? In the end the list remains and other Sgts got added. Scamming will be more difficult, there will be more attention paid to the actual construction of the exam and DCAS had to relive the nightmare of this exam. Let's all stop it and be happy with the resolution.

I think this was a well orchestrated campaign by the slimy 9 lawyer. They didn't do an article 78 first because they needed all the Media attention . There lawyer had to know they were going to be laughed out of federal court, but in reality it wasn't a loss for them. They succeeded by shining light on there cause, and embarrassing the Nypd and dcas . They got the case dismissed without prejudice, enabling them to file article 78. The original passers freaked out and retained council, which ultimately benefited the slimy 9. This lawyer is a genius and succeeded by accomplishing the unthinkable..
On the flip side this sets a bad precedent and people shouldn't be able to sue to get on a promotion list. These are the times we are living and everyone Sue's to get what they want. I am also truly happy for the lotto lieutenant.

Flamingo, I agree with most of what you said but I was trying to explain why there is still animosity from many.  That's all.  It is over. GD, I agree with a bit of what you said but again, they could of accomplished what they needed to without the smear campaign and jeopardizing the list.... And getting their federal case essentially dismissed was not a tactical plan lol.

I think most importantly, this lawsuit exposed that the tvb had an agenda... The very construct that was supposed to fix mistakes on the test so no one would have to sue, failed to do their job.
