Another gem from their complaint is they ask for 6 questions to be tossed. Then the test to be regraded by the remaining 94 questions. This would give each a question higher point value and make it impossible for anyone currently with a 65 or lower to pass.

lol I highly doubt that is what their strategy is.  Maybe this was misinterpreted, but I'm sure that by tossing the 6 questions, It would act like it has every other test when they toss questions.... In effect its not actually tossing the question, but making every answer right.  So the right answer to question 106 would read ABCD.

 It's 100% their strategy. It's states so in the complaint. Tvb is over, so its not possible to toss questions and still get credit for them. Questions would be tossed completley from the exam, and the exam regraded on 94 questions. States it 5x in legal paper work. All you have to do is read it.....

Again civil service law states the judge cannot change or toss out specific questions. Her only option is to invalidate the entire test, which will open Pandora ' s box of lawsuits and counter lawsuits for this exam and all other city exams

 I don't think that's true ... They argued over specific questions at the last hearing.

 

I have no idea, but the way people that were there made it seem that way. they aren't suing for the list to be tossed out, since it's not in their complaint, so if that's the case wouldn't their lawsuit have been tossed already?

New York civil service law, title a, section 50, section 7 pertains to court review of civil service exams. It reads that after the review process has determined what answers are acceptable, the answers cannot be subject to further review in court. The court can only review to determine if established review procedures were followed. I am paraphrasing, but you can check it out yourselF

I'm not sure, sarge. I didn't research that. I was only concerned with how civil service law pertained to actually throwing out specific questions and if the judge could legally do so under that law. If I have some down time today I'll read through it more and let you know if I find the answer for you.

Anyone have any updates on the lawsuit ???

I'm hearing the judge is looking to approve 5 out of the 6 questions to be thrown out. Now the city has to agree and approve it to move forward.

I heard the same rumor spreading late last night in a Bronx precinct. I have no idea where it came from, no one would say....which makes me highly suspicious. I'm not getting my hopes up.

 It is more then likely going happen. 5 out of the 6. Next week there should be some confirmation once  the city officially signs off and agrees.

It's confirmed, the lawyers for"the 9" came to an agreement with DCAS in which 5 out of the 6 protested questions were thrown out; I don't know what 5 questions they were.This information is direct from someone who was involved. The judge in the case approved the agreement, and it will be finalized on Monday.

 I heard this directly from people involved. It's my understanding the city wants to settle this and put a class of Lt's in for promotions on the 24th. There was an adjourned court date yesterday and one scheduled for Monday in which I believe the settlement will happen. Captains are scheduled for promotion on the 24th.
