What is the goal of this lawsuit? The 9 sgts bringing the suit obviously failed. The city isn't going to "curve" the test or reconsider throw outs.... neither of which solve the issue in the suit; which is cheating.
So don't they have to be aiming for them to toss the whole list? It can't just be investigate or pass over the cheaters, because the people bringing the suit wouldn't be benefited by it.... they failed.
When you think about it, by the time this lawsuit gets into the court room and they've spent all that money litigating hoping to get the list tossed, won't the existing list be almost exhausted? Sure some cheaters will have skated by, but at least no innocent people will be affected by passing and their list getting tossed.
The court papers suggest that there was a chance to cheat both on the original date and as a result of the protest session. If that's the case it would mean everyone potentially cheated. Curving it would not address these concerns, after all, even a guy with a 69 could have cheated and still failed. I don't see how this lawsuit benefits anyone at all unless they are truly leading the charge to have the system changed by sacrificing all of us. I hope they dropped logs as soon as they left the test site regarding all those whispers they heard in the bathroom.

yes. I never heard any rumors about cheating on April 18th, these guys failed to report corruption or are telling tales.

Which is when we'd ask for an injunction to stop all LTs exams until everyone is rightfully promoted. If anything they've showN Us how easy it is to file a law suit.
How is there a fast turn around? A test still has to be written, administered, graded, protested, published. We would likely be through 204 names by then. The only benefit would be that there would be so many vacancies as a result of not promoting for such a long period of time that the top of that list would be promoted at a rapid rate once a new list is established.

What fast turnaround? This will delay things. A 204 person list will last 18 months top, they were slated to announce a new exam any week now. This won't make it faster to take another test.
This lawsuit is fictitious and eronious. The job should not even entertain it. The job received an allegation involving cheating. "AN ALLEGATION", the job should do there do diligence and conduct a thorough investigation in an expeditious manner as they do with all allegations even though they have no legitimate basis, such as this fabrication. After IAB concludes that there was no widespread cheating hence only 164 passed on original test date and half make up test takers failed they will proceed with the promotions. These 9 lyers should be disciplined by this department for lying and bringing negative attention to the department then they should be prosecuted for perjury. The system is what it is, there will always be makeup test takers because it's federal law. We should respect our soldiers and our fellow Sgts who practice different faiths instead of labeling them as cheaters because they passed and many failed a very difficult test. Who does this, this is so sad and it will lead to more false allegations on future exam because of jealousy and envy. These 9 are showing there true colors, they have no integrity, no morals and that is what the media should be writing stories about because it's the real story.
It's a sad day when we start to question the integrity of our soldiers, and those with different religious beliefs and attempt to invalidate there make up tests because selfish individuals did not receiving passing scores. How dare they do this. Where is the integrity and respect. When Blatt, Naik, Fasciano and the other losers are on their couch watching movies eating chips the so called scammers are fighting oversees or training and readily available to go any where in the world and fight for this country. And they are the scammers? No I don't think so and its sad they feel that way. Over 4000 soldiers lost there lives fighting for this country from 2003 to 2015 and many NYPD officers. Would you still say they are scammers? 164 Sergeants passed out of 2400 Sgts and you claim widespread cheating occurred. Stop and do the math, that is obviously false. Blatt, Naik, Fasciano and the other scammers on the lawsuit are the real scammers whos motivations are solely based on envy and jealousy. Be real men, study and take the next Lt. test. Stop lying and labeling all passers who studied hard as cheaters.
I read the whole lawsuit. It's mostly speculation or complete fabrication. Let's see what happens tomorrow. I honestly think this lawsuit Won't go anywhere and the whole list gets promoted. There is no reasonable explanation to not promote everyone that took the test and passed on the original test date. Even the makeup test takers will have to get made Unless there is proof they cheated. At the end of the day this is a minor rain delay..... In the highly unlikely chance that something absurd happens we will higher one of the best law firms out there. Nobody panic. We are getting made.
Thanks Bigfoot, needed that. I worked way too hard for this nonsense. PM me any info on a potential law suit filed by the passers. I am willing to unite and obtain what we deserve. We achieved so much and cannot allow this false allegation nd eronious law suit to interfere. They have reached out to the media and are spreading their fairy tales. We cannot be quiet, we have to reach out to the media and express our concern that 9 disrespectful sore losers are attempting to undermine federal law and discriminating against military and those with different religions. We are hard workers with integrity and 9 weasles are labeling us as cheaters. The media needs to put the real story out.
While Blatt, Fasciano, Naik and the others who filed the lawsuit upset many people, they are stil cops and are probably decent hardworking individuals but they are holding up the list and going about things the wrong way. Maybe they will reconsider for the betterment of everyone.
To complain about ambient noise and the windows being open is an absolute disgrace. Nonsense like that will hopefully lead to this lawsuit being completely thrown out and promotions begin soon after.
There was a high school football game going at my location for the 2013 sergeant test, complete with band, cheerleaders, and public address. DCAS also threw in an extra THIRTY questions with NO extra time.
This lawsuit puts the city in a really tough spot. The media will spin and twist it to add maximum embarrassment to us all. I really wouldn't be surprised if they just scrapped the whole thing. It'd take at the very, very least 9-10 months to hold a new test and establish a new list. All the while with no active list to promote from. This point alone may keep the city from throwing it out.
Good luck, guys. What an effin disaster. There's no easy solution. I'd think promoting the 164 and holding back the make up test takers would be the most logical solution but that opens up a big can of EEO worms we all know the job and city do not have the stomach for.
40%+ passing rate for makeup exam vs 7% for original test day. I'll just leave that here.
-Once we found out who the department chose to right this exam, we knew the was going to be a disaster. We knew the Captain in charge of this process had and still has a personal vendetta against this department, yet the department kept him in charge of the process.
-Once we left our respective test site on April 18, many if not all of us, knew this exam was not written for us to pass. Hence the 7% who initially passed.
-That exam was a far from perfect written exam. We waited 10 months to learn DCAS made zero changes, after knowing this exam was one of the most challenging Lieutenant exams given.
-We were even more upset to see that 48% of those who took the make up exam passed when only 7% of the initial test takers passed.
-I can not sit hear and say that everyone who took the make up test is a scammer and cheated, but those passing rates speak for itself. The scamming and cheating has been going on for years.
-These exams are poorly written. DCAS approved 19 changes to the 2011 Lt exam. Only 7% passed the the 2015 Lt exam given on the initial date. There is something wrong with the process NYPD administers promotional exams.
We wanted justice. We wanted our voices to be heard. How else would we break this unfairness/ unjustice cycle.
We are upset at the 9 who brought the lawsuit, who spoke up for our cries, when we should really be upset at those "cheaters/ scammers."
Dos Equis, that seems like a very thoughtful and reasonable stance. Here's the problem:
These 9 are not doing this to right the system. They're doing it to get onto the list. if the city negotiates tomorrow to add them on, they will drop the suit in a heartbeat and let business as usual continue. In the meanwhile, they seem to be willing to throw the baby out with the bathwater, IE the original 164 non cheating passers. If it is truly justice they seek, they should be more concerned about that. These 9 are not heros, simply opportunists trying to scam their way into the rank without studying again.

If this lawsuit is able to get these guys and the ones who just missed onto the list, would it not be worth it. There is no way the department will throw this list out, the ones that should be worried r the scammers with the drill out of no where and the old line of duty acting up. Or that sgt who had an emergency search warrant that he had to do that weekend. Last time i checked the another sgt, or Lt or Captain could of done it.

We all know how tough that test was, it was designed for failure. I also agree that if any military personnel who scammed and set up a last minute drill should be dealt with as well as the old line of duty guys. I don't know you, Blatt, Fasciano, Naik or the other individuals on the lawsuit. You guys are good people I heard, so I apologize but I just think things could have been done differently. I agree with common sense.. The true elite 128 should have nothing to worry about.. you all will get promoted in due time as you all deserve. It's a strong statement to say all who took the make up test is a "cheater/scammer," however each and everyone one who took the make up exam should be investigated and interviewed. The passing rate of the make up exam is alarming. Those who passed the make up exams should have their promotions delayed until a complete and thorough investigation is completed. If you have a legitimate reason to have taken the make up exam, thank you for your service, happy sabbath and I wish you a speedy recovery on your line of duty injury.

Cowboy1 where's the integrity ? And why are we question our military people? Are u kidding me. 3 cops that I know who are in the military texted me to help them. No bull****. One even admitted he was going to reschedule the test even before it came out and he did. He would always be on his phone talking about the test to people so don't come with this integrity bull****. I'm not saying all cheated but this scam has been going on for a while now. Your either part of them or plain blind. More power to these 9 for suing , something that most spoke about including myself but never did.

Thank you Cowboy. I wish we all can stick together as Sgts and a police department as well. I understand your frustration. Not only has this exam killed morale, this exam dismissed the opportunity to promote great leadership. I am not part of the nine whose suing, however, I do support this lawsuit with hopes that this lawsuit investigates those who took the makeup exam and revisits the process of how they administer future exams. The cheating and scamming has gone on for way to long.
This lawsuit was a way to shed light on what has been overlooked for many years. I have great friends who passed this exam. This exam has been one of the most challenging Lt's exam known to NYPD history. It was not a perfect exam for DCAS to amend zero changes. Perhaps it's this lawsuit that would help DCAS see that.
Again, I understand your frustration but I also support those 9 who spoke up and are trying to pave the way for the betterment of this department.

However, as everyone knows this time there was a tiny fraction of passers so the makeup people stood out. How do you explain the soaring skyrocketing scores of this group? are they that much smarter then everyone else? 104? 99? 90+ on this exam? No way my friends. You took it, I took it- it was the most difficult exam any NYPD sgt had ever seen. I feel for the elite, but this is real change. The Band of 9 assembled and went into the lions den when no one else would. NO ONE. The thing that really is disturbing to me is the backlash the elite has given the Band of 9 when the makeup scammers cheated them on list number(seniority), vacation picks, and bottom line money. They are the ones the anger should be towards. The Band of 9 has captured the media s attention, the commissioners, and the entire job itself. All I see from SOME of the elite's is a lot of me me me, i want my prize. A true one way position that cares not about the process and the ability for their brothers & sisters to advance, but only themselves winning.
