I want every smart man and women from the elite to breathe. I want you to think. I want you to rationalize and break this all down. 1- a federal judge will either grant or deny an in juncture monday. The job has ZERO choice but to cancel promotions bc if the in juncture is granted...then it's safer to cancel promotions on a Thursday rather then scramble on a Monday at 1800. 2- break down the arguements presented. Loud noise?? Oh I'm sorry guess the whole world should stop on a spring April day so you can pass a test. Proctor leaving and bathroom talking??? Really?? I hope the sgt who saw that made an immediate IAB notification for corruption. Answer key being posted? If someone took a picture of they key that would be an individual problem not relating to anything to do w any test taker. Finally the questions...shame on you if you provided questions to any future test taker. Ppl talking about questions will never change....what needs to change is the administering of future tests. All stuff that concludes no one I can see who went out of their way to cheat. Any at test taker where there's proof he saught out questions should be dealt w swiftly. This will all come out ...you're hearing a one sided story by a bunch of sgts who are feeding the media what they want to hear.

Curving the list is not going to happen. Only two options I see (1) Throw out the whole exam and start from scratch or (2) Everyone makes the list and the people at the bottom just die on the list like in the past.

City won't negotiate like that. I'd bet if an injunction is granted, they toss it. Which will result in a huge lawsuit vs the city and the lying sgts. Or if no injunction they'll promote and investigate some alleged cheaters.

This is not going away that easily. Either way the city turns there's going to be a lawsuit. If they toss the list the original 164 passers have a case. If they keep the list those that failed have a case. Then those that get passed over by an alternate test taker have a case. Too many people got hurt this time around. Promotion to Lt is a big step career wise.

These are the only 2 scenarios I see happening. They would scrap it before they curved it.

Also, I read the court complaint. It only has cheating allegations in it. Nothing in there about bad TVB or 70 passing is too hard or anything like that. Cheating allegations don't make failures into passers.

I'm in as well ... I believe all the passers will be willing to put money towards legal proceedings... However finding good counsel will be the challenge ... Just based on a Sba lawyer who is also a sgt that closed on my house ...... Probably not getting anywhere fruitful with the Sba

I say,, we should start getting together and really start looking at different law firms because I get the feeling this is about to get ugly.. those of us who passed the exam on the initial day of the exam should STRONGLY consider joining forces. all the time away from your family / kids ,,the hours spent at the library studying ur butts off in order to pass this debacle of exam.. and now we have to deal with this B.S of the possibility of the list being thrown out ! .. There is no justification on why those of us who took the exam on the initial day shouldn't get promoted ...if the issue is how the "scammers" made their way into the list ! .. let's just pass them over for promotions until it is investigated !! .. I'm pretty sure nobody would have an issue with that !..

the only people who should of had a say were the original passers...the cheaters only bumped them down the list... the scammers didn't effect any of the original failures and now 9 crybaby failures are exaggerating and are claiming rampant cheating....i hope nothing comes out of this but a small delay and a hefty bill for those newest 9 scammers.

yep. We should also seek an injuction to stop any future LTs test until the original passers have been promoted ( if not jammed etc.). Let's take a deep breath and see where we are Monday. Will be easy to get a cpl of us to make calls and meet up for sit downs.

Papote, I agree..... I can see them promoting all of the original passers and delaying the scammers or even dismissing the from promotion... But their just isn't any justification to throw out a list that has 164 or whatever Origional passers

If DCAS would have just thrown out obviously flawed questions like they always do this never would have happened. Zero changes is what screwed us, heads need to roll at DCAS, glad they're the ones being sued at least. Maybe if they will just accept the changes submitted by the TVB and add to the list all this can go away?

Also in for the lawsuit if the in juncture is granted on Monday, will be in touch. I have a small squad of original test day passer friends that are in as well. Hopefully this doesn't break the bank, but this is what it might come to.

i have a squad here as well. We will exceed 100 people easily. Hopefully it's not necessary

I hope u are right. I have a huge headache over this. I thought the worst was over. I was wrong. Studying for this test was the hardest thing I've ever done. I was a new mother and instead of taking care of my newborn i decided to study. I ultimately decided that for the better of my family and if they take this away from us... It's too much.

Isnt curving it just as much grounds for a lawsuit as throwing it out? That makes everyone else have to wait longer now for the next exam because the list gets bigger. And why should a 64 have to wait as a 65 makes the list. Throw this POS exam out for Christmas sakes.

An unholy alliance.

We might have to join forces with them. Like it or not, our fates might be tied together with the makeup exam passers. It has come to this, passers vs. failures.

As I've said before, you can't be too mad at the makeup testers, maybe the LOD, but not those with legitimate reasons. If I took the test months later than everyone else even if I had no intention of actively cheating I would automatically have an advantage. This is a broken system, the City allows this to happen and hasn't done anything about it for decades. It's literally entrapment to set this system up and then say they "cheated."

If things go downhill on Monday I'm all in no matter what, but I'm open to the unholy alliance. Hopefully it doesn't come to that.

Hopefully nothing comes out of this besides a little delay. But if it does, I am IN (original passer).
Simple solution to all this, start promoting original passers while investigation is being conducted on makeups. Then come back to either promote or disqualify them. Problem solved.
