I agree, mental anguish is an understatement and the nightmare continues.
1. Investigate allegations of cheating and act accordingly. This will take forever and go nowhere.
2. Promote everyone. With a public lawsuit and this cheating scandal in the papers this would make the department look real bad. Bratton does not want to admit that yes he let possible cheaters be promoted.
3. Throw the test out. Make the future tests on one day on a wednesday.
Either way this is a **** sandwich that we all have to take a bite of.
Why can'take they keep the list and change it to a Wednesday in the future? Every test for the past three decades has been this way. They would have to demote everyone who took a promotional exam that had a makeup exam involved.
If they can't prove definitively beyond this bathroom cheating for the original passers, they're gonna have a big lawsuit on their hands. What's the proof gonna be? One of the slimy 9 testifying they heard some guys whispering in the bathroom? That's not gonna cut it!

I couldn't agree more,, talk about low morale on this job .. imagine if the exam gets thrown out, the morale among supervisors on this job will explode to be at an all time low especially if we have to pay the prize and not get promoted ... NO WONDER WHY WE ALL HATE THIS JOB !!
Food for thought here. If 9 dudes can make a lawsuit to throw out an entire exam, what's to stop this in the future?! There's always gonna be disgruntled guys who fail every test. And unless they lock future test takers in a box on test date, there's always gonna be guys looking for some sort of edge.
Even if you locked them in a box it wouldn't fix the problem. You're right though, why even take a promotional exam? Why take the next one if this can all happen again?
I would say cheating appears to be blatant on the make-up exam, a conclusion we have all drawn based upon an unusually high passing rate. I assume no one here has concrete evidence of actual cheating.
There's definitely no concrete evidence of cheating on test day. If you read the filing order it's just vague crap about whispers in the toilet. If they go any further than that they're opening themselves up for perjury charges.
At no time will I ever attempt to think and or speak for why another man/woman had done something. But I really feel that dcas and the department brought this problem on themselves by not at least thrown out or made a double answer for one of the many iffy questions. The list would have increased 100 names and it would have business as usual Even if they were slotted for only 204 LT spots. It wouldnt have been the first time that a list was cut.

I studied very hard, wasted a lot of money and failed the first test. Honestly I hope everyone gets promoted from this list and I hope they don't throw out this test. I don't care much for the people that cheated. I just want the guys that really passed to get promoted because it's not fair to them. But at the end of the day they just need to change the date for future exams. Something in the middle of the week which will eliminate a lot of the restrictions for people that can't take a test during the weekend. Or maybe create 2 difference exams for the regular test takers and the make up test takers.

I agree with the test in the middle of the week, but two different exams would only give the crybaby era SGTs another reason to start crying again

I gotta agree with this. It was really just a combination of things to piss people off... If the test itself were fair, more would've passed. And the cheaters would've just sort of blended into the crowd. If they had had some throwouts, more would've passed and it would've at least shown SOME acknowledgement on the job or DCAS's part for how screwed up the exam was, but they went with no changes. Add in 20 extra research questions, a makeup date 2 months later, new testing procedures (no one who is not eligible to be promoted can take it) and you've got a perfect storm.
They either throw out the whole test or only hold up the people they have specific knowledge/allegations of cheating against. Never in a million years would they promote only those that took it on the original test day. Then they'd be punishing somebody for their "religious obligations" with no suspicion of cheating. Wouldn't happen.
What happened when they threw out that FD test? What ever happened with their lawsuits?
