Bigfoot... Yes, I'm interested in just a few, but that is why I need everyone to join this so they can protest another few and a few more which would lead to a lot. I'm also interested in the cheating scandal. But all of this will be explained the attorneys and I'm sure they will give advice towards the best direction.
I agree with bigfoot. However, it may be a good idea to present a few ground ball changes just to use as examples of flawed questions. It's simply a matter of demonstrating that the complaints are founded and worth pursuing. If they take the ball and run with it they can go after any and all flawed questions and the arguments TVB presents for keeping them.
This isn't about getting you or me on the list. It's about arguing for changes that are just and fair. If it's successful, it could lengthen the list significantly. If not, no one is the worse for wear (minus the cost of the lawers anyway). Naturally, the othe issues discussed on this site should be discussed as well.
Just an FYI I think 7 stood because the ts guy had meal therefore couldn't be notified
Ah thanks, that was one Hell of an in-basket.
Number 1. I have talked to many people about this, and i mean many, and not one person can say why the answer is A. I have heard many of why it makes sense the answer is B. Not one person has been able to identify an item in the in basket that points to A.
Also be careful about going after questions. Wait until protest review comes. They specifically say agencies always win in these type of cases when they have written explanations for thier records.
Would it be possible to reach out to mike Yano or the Owers of the key. They may have more information on which questions should be protested, and perhaps they would know why.
the protest is over.....what a lawsuit will be is a article 78 hearing. Typically article 78 hearings consist of both parties submitting in writting their arguements. You CAN ONLY ARGUE that the points made by the previous protests were not adequately considered by DCAS and that their decision was arbitrary and capricious. Meaning they were made on unreasonable grounds or without consideration. This is a huge task for you guys to complete. I wish you the best...i think most ppl on here will tell you that we consider it unreasonable to have zero throwouts....but most courts side with agencies on these decisions and our opinions really dont mean much. Hope you guys get what you wish but id study just in case because you got a mountain to climb. I believe i remmeber reading about a article 78 working in the 80's though...so mountains can be climbed

Hers a question... Does anyone know if there are research questions on any other exams administered by dcas for other departments? Does FD or NYC dept of finance have them? If not why just PD?
This list is very short. People are forecasting an exam within 10-13 months from now.
How long is this lawsuit going to take? Obviously more than a year, and the way things run around here its probably much longer. So what are people planning to do? Not study for the next one one and hope to get retroactively promoted off what will be the old list? Winning is obviously a longgg shot (doesn't mean you shouldn't try) so to do that you'd have to be willing to be stuck a Sergeant (and obviously you really don't want that because you took the test and are now willing to pay to fight and get the rank). Or do you study AND pay for the lawsuit?
Also, after almost EVERY exam there's talk and planning of a class action lawsuit. What ever happens to those? Did none of them ever even get off the ground or were they just shot down?
All great points. I wish I had answers for you. If the last few weeks have shown us anything it's that your questions regarding the viability of a suit, win/loss ratio, timetable, etc. cannot be intelligently answered by anyone on this forum. Thanks to Windeast, we'll start getting feedback from legal professionals today. Hopefully this will at least start to provide real answers to some of our concerns.
In my opinion, assuming legal action is pursued, regardless of the status of the case, anyone on board who wants to be a Lieutenant would be a complete fool not to study for it when the time came.

I just checked the the 2015 NOE for FD Lts. Nothing there about research questions. There is nothing about them on ours either. I guess you'd have to ask somebody in FD. Here is the link to their NOE:
On a side note, it looks as though their tests are computerized. Ours says computerized or pad and pencil. Latter 20th Century technology?! Imagine that! Furthermore, their raw score on the written is only 50-percent of their total score. The rest is based on their seniority and awards. They do need to get a 70 for the latter to count. Not that it applies to us but I thought that was interesting.

A lot of great info were exchanged at the firm... I am not posting all the info on the thread... If you are interested in the lawsuit, message me and we'll take it from there.
Personally I think this whole law suit thing will not end positively for us because a law suit is very time consuming, and costly...on top of that, not too many people (maybe less than 20) are truly willing to take time out of their busy lives to pursue this. Besides, the lawyers are the only "winners" in this case because they will get pay regardless of the outcome of the law suit. The best we can hope for is for future exams to be more fair too ALL test takers. Let's hope that an exam will be giving next year and let's hope that this list finishes within 2 years or less...
Meeting at the law firm tomorrow at 11am. ANYONE wanting to go and ask any questions in regards to the lawsuit, please message me and I will give further info. Just cuz u go does not mean you HAVE to be on the petition. This is just a way for sergeants to come together and see for themselves what the law firm is about and what their plan of action would be.

So we know the ring leader here. Haven't heard much chatter from a few screen names on here.
