How many times do you have to be chart changed before it can be put in as overtime? And is it anytime your tour is changed or is it specific instances?
I believe it's 20 tour changes, plus 5 tour changes for details. It's a contract thing. You can go to the nyc labor relations website and read through them.
I attached a copy of the text but I'm still not sure on the wording. So they can only tour change you 15 times if they give you less than 24 hour notice, but if its given let's say 3 days in advance they can tour change you as many times as they want?
From my understanding of it, they get to tour change you with at least 24 hours notice 20 times. On the 21st time they have to pay you overtime for the difference from your regular tour to the tour they change you to for that day. On the 21st tour change If you regularly did 1500x2335 and they change you to 1200x2035 for that day, you would have the option of working from 1200 to 2335 and make three hours overtime or just doing the 1200x2035. If they give you less than 24 hours notice you would also be entitled to the overtime.
Beuford is right. But the less then 24 hour notification doesn't count towards the 20 tour changes. Also, there are certain dates that don't count towards the 20 tour changes as well. They are the Puerto Rican Day Parade, West Indian Day Parade, Thanksgiving, New Year's Eve, Columbus Day, St. Patrick's Day and 4th of July.
Lets say you come in today for a day tour and they hand you a notification to do a 0500 start the next day, its less than 24 hours notice. So you start at 0500 the next day and if you want you can stay till 1552 and make the o.t. for the 0500 till 0655. You still have to work the hours, but for the tour change part you will receive o.t. But, like I said earlier if you elect to take the o.t., it will not count towards the 20 tour changes. Hope that answers your questions.
