This is true and if I am not mistaken, it doesn't even say the phrase, "But Not Limited To" either.
I know it was quoted already but the verbiage is pretty clear cut. If this was a court case, they'd be thrown out:

The test may also include questions which require the use of any of the following abilities:

It does say "may" but the way it's used doesn't seem to apply to the materials it's based on.
Anyone talk to the Key guys or Yanosik to see their input? If not, I'll send out some emails.
I emailed Yanosik. He just said that he had been made aware of it and that when the protest got closer he would advise us. He didn't give an indication whether he thought we would be successful or not. I did not email the key, but I'm sure someone has by this point.
Does anyone remember exactly how many operations orders questions there were?
the pony tailed captain is aware of people discussing the test questions after the exam. rumor has different question, including a different in-basket, will be given to those who did not take the exam on april 18. I also heard different sample questions will be thrown out from those who took the exam on april 18 from those who are scheduled to take the exam on a later date. hope this helps good luck.

You nor anyone else should post any insight on the test. If alternate date test takers get info from people, so be it. Let's not make it easier by giving away info on this forum

Protest Reminder
Remember, the official answer key to last weeks Lieutenants test will only be made available at the protest session (another inconvenient, disrespectful and unannounced change). Get your protest application in the mail today -it has to be postmarked byno later than tomorrow.
Also note, you have to bring copies of the procedures you wish to protest and hand them in with your protest. This means you have to print out and bring them with you -electronic devices will not be allowed.
This is all ridiculous and demeaning. Were trying to do whatever can be done. Weve researched the City Charter (Section 815.6) and it looks like DCAS has far more control over this than the Department does. The level of disrespect for the hard work and determination we have all put into this is unacceptable.
If anyone needs Administrative Guide procedures that were in effect on the cutoff date (Jan 18, 2015), let us know, we can email those to you.
Also be advised, A.G. 322-29, Department Directives says that An Operations Order may contain:
Orders or details relating to a single event or condition that will exist for a limited time
Instructions, information or directions for compliance with or clarification of, an existing procedure or law to achieve uniform performance
Announcement and/or scheduling of members to attend Department training programs
Announcement and/or instructions regarding implementation of a pilot program.
PROCEDURES MAY NOT BE PUBLISHED IN AN OPERATIONS ORDER EXCEPT WHEN NECESSARY IN ANNOUNCING A PILOT PROGRAM.
Operations Orders expire upon conclusion of the event or situation which is the subject of the Order, or one year after publication, unless otherwise directed. Operations Orders are published by the Office of Management Analysis and Planning after approval of the Police Commissioner.
I could agree with this statement at least the key (not to defend or anything) and rising star have been on the move, well as far as I could see anyways.
Advice for anyone pursuing legal action.This information is from my personal experience, and is only meant to assist and prevent those from making the same unfortunate mistakes I have made in the past.
1.If you are considering, entertaining the idea of or are hell-bent on an Article 78 Federal proceeding, you have only 180 days before the statute of limitations (SOL) runs out and you forfeit any right to pursue legal action in Federal Court against DCAS, NYC.It is next to impossible to accomplish an article 78 hearing without retaining legal counsel.The SOL is completely real, and the kicker is that by the time someone attends the protest session, obtain a reviewed answer key, attends the Test Violation Board findings based upon all the protests submitted, the SOL has LOOOOONG been expired.On purpose or strategically scheduled, the City has everyone by the ballz b/c you may only first discover how ridiculous a fact pattern originally was, followed by how ridiculous the TVB ruled on the matter, you cannot pursue one of the Citys ultimate fears, Federal Court ruling on the matter.
How I understood an Article 78 to truly work would obviously start with filing of an application in Federal Court to have a Docket assigned to you.I do not remember the fee, bc had the expired SOL situation happen to me.This should be DONE immediately if you truly want to hold onto your right to protest.If not, the SOL will expire.Once your docket is called it can go 1 of 2 ways (1) the judge reviews the supporting evidence submitted and makes a ruling or (2) judge kicks the matter to those winners on jury duty at that time.I understand that the judge ruling occurs 90% of the time for Article 78. I never got to this point bc I pursued a case waaaaay too late, BUT I had just literally walked out of the TVB publication of findings on the protests. Done before I started. I should have filed immediately and maintained or built my case over time.
2.Another piece of CRITICAL ADVICE:If you fail to respond, answer, submit, request any correspondence you receive from the City regarding this Exam once you receive a mailing, you will forfeit certain rights to appeal with different legislative bodies.For example, once you receive your official score in the mail, there is an option to request a review of your actual answer key you filled in on test day.YOU MUST SUBMIT THIS REQUEST REGARDLESS OF HOW CONFIDENT YOU ARE IN WHAT YOU FILLED IN.The point is, NOT SUBMITTING THIS REQUEST, actually forfeits your right to appeal the findings of ALL MATTERS CONCERNED WITH THE EXAM.Once you submit the request for the review of your scored answer sheet, you will receive yet ANOTHER RESULTS REVIEW where apparently the real, final score will be listed.HOWEVER, the bastards do NOT tell you that failure to answer the fine print on the bottom of this 2nd request will prohibit/deny/stop/impede you from any future appeals process with the New York State Civil Service Commission as opposed to City agencies, or any attempts thru DCAS, Human Rights Commission, or other, etc etc etc.Simple little lack of a 2nd response you might think, but it forfeits a whole lot more.
This was my experience, and I dont want someone who honestly seeks some resolve on this debacle of an exam to fall prey to the same traps I did.I hope those interested have access to an honest and hardworking, savvy attorney to represent them if they choose to go the Article 78 route.THE CLOCK IS TICKING ON YOU.Hope I stressed that enough.
Also, if you receive any piece of mail from DCAS, City regarding this Exam, make sure you answer it, respond to it, challenge it, PHOTOCOPY it and READ IT.
