Got a quick question. I know that if you are under iab investigation, they skip you for promotion. Now, if that investigation is unfounded or unsubstantiated, do you get your time in rank retroactively? What stops someone from making a bull**** allegation against someone who is not liked and getting ready to get promoted?
Probably not the answer you want to hear but the answer is no and that could easily happen. When you are the subject of an allegation the investigative unit assigned (IAB, an investigations unit or less likely your ICO) is contacted and asked about the progress of the case. Depending on the seriousness of the allegation it is possible to get promoted before the case is closed as long as the unit assigned is confident that the case will not result in a finding of substantial misconduct. If that unit says to hold then they just pass you over without telling you the reason. Usually when the investigator assigned becomes aware of your pending promotion they try to fast track the case, but it really does depend on how extensive the investigation is an how quickly the ivestigator can get it done. As far as recieving your time in rank retroactively, good luck. You would probably have to sue and prove that the Department knowingly held you up for a false allegation. However the Department refuses to pursue people who repeatedly make false allegations against cops out of fear that they will discourage legitimate complaints from being reported. In all likely hood if the allegation against you is BS they will classify it as Unsubstantiated, meaning they can't prove or disprove the allegation...so to sum it all up be fair with the people who work with and for you and you should be ok.
