another one that was an error on there part and should definitely be thrown out was the ecb summons in the inbasket! I dont know how many people remembered this but a few did, the calendar provided by dcas in the inbasket had errors on it. I think it was a typo but so what, they used nov 8th twice and skipped 9th and if i remember correctly there were no holidays listed on the calendar and there are a couple in november. I believe ecb return dates your not to include holidays and weekends in counting. I could be wrong but just for the fact that they had a typo on the calendar it should be tossed for screwing with our heads cause it did with mine.
If I'm not mistaken, the 49 in the packet regarding summonses was stated 30+ days for criminal summons return dates only. Would an ECB being a civil summons be nitpicking? I got a very low score and need about 50 throw-outs, but remember asking myself about this question while taking the test.....
i am going to fight it and i dont even know if i got it correct, your right its a civil summons not a criminal summons so the 49 didnt apply but the calendar provided was inaccurate
it was if you looked past the mistakes they made, but i figure might as well inform everyone just in case ppl got it wrong, anything as a typo/ mistake on dcas part should be an automatic groundball for a throw out in my opinion
The ECB was a complete ground ball...FYI...when they say not including weekends and holidays they mean if the return date falls on a weekend or holiday you go to the next day!!!! All I have to say is NO WONDER
It was a ground ball....and I dropped it. I would love to protest it but the holidays would only have screwed it up if the return date actually landed on one of them. I think I'm out of luck on this one...
