The goal of the 123 interveners:


1st off. I will gladly tell anyone I see in person that I am one of the interveners. I don't care. I know what our intentions were. The purpose of this thread is to dispel nonsense rumors about our goals.

All of the 123 interveners were original day passers. We all earned our passing score and we did not cheat and we did not have an advantage of a makeup test date. Our goal with the intervention was simple: PROTECT THE LIST AND GET PROMOTED.

The slimy 9 are lying to you about what they say our intentions were. They claim that we tried to prevent additional people from getting on the list. That is a LIE. Our only goal was to protect the list because we legitamately earned our passing score.

The reason we had to protect the list is because the slimy 9 wrote in their court documents that they would like the list invalidated if their demands weren't met. It was written all over their court documents and also discussed openly in court. If you don't believe me, read the court documents / transcripts.

They created lies about people cheating on the original test day in order to gain leverage and come closer to their goal of getting on the list.

The 123 interveners would have supported their endeavors from day 1 if their goal was just to expose make up cheating and get the ops orders / crime complaint reference guide questions tossed.

We were forced to intervene because one of the side effects of their lawsuit could have invalidated the list completely in which case all of us that legitamately passed on the original test day would have had to take a new test all over again. That would have been unfair on so many levels.

During negotiations our lawyers actually helped convince the city and Judge Chan that a settlement was the best option. The city wanted to fight the slimy 9 lawsuit to the end and our lawyers successfully intervened and helped to persuade the city to accept the deal. This is a FACT. (No I am not Ondeeair - he failed)


We are all actually very happy for the additional people on the list, but the LIES and DECEIT by the slimy 9 are the reason I will forever refer to them as such.

I don't care what they think. The slimy 9 made up lies and their lies could have resulted in the list being invalidated which would have screwed all the legitamate original day passers. Like I said, if their lawsuits goal was simply to expose the makeup cheating and go after the questions not listed on the NOE, then we would have supported them from the beginning.

Contraband is correct in what he is saying .. As far as the 125 getting on the list now... awesome for them I have very close friends that now make it .... Having said that I have spoken to them and even they have said they do not agree at all about how the 9 or 7  went about it ... Everyone knows they should of went after the questions from the start and not all this cheating nonsense and especially with the bathroom whisper nonsense

It's not just the original passers though bashing .. In the last 24 hours I've seen numerous posts on this site and on their fundraiser page bashing us and cursing expletives. On top of that the 9 are saying the intervenors caused 106 to stay put.. Which doesn't really make any sense what would the point be , none of us had any emotional ties with 106.

To be honest why would we original passers be crafted as the bad guys. We didn't retain counsel till months after they did meanwhile we were completely put in the dark from the Job and them... No idea if the test was getting tossed . As well as being advised to retain counsel because corp counsel was completely inept and they were gung ho about appealing anything further dragging out the process

At the end of the day I try to see things for what they are ..
Job and dcas handled the whole process from the making and the end abysmally

The make ups flew right under the radar I find it amazing everyone forgot about them

The 9 or 7 or whatever enhanced allot of careers for allot of great sergeants
And I'm sure one of them in particular has serious character issues.. I won't post names as he does but I hope for his mental health this resolution heals whatever ails him mentally

70please it's true the makeups are the big winners. All this other nonsense has distracted everyone from that. As far as the intervener bashing goes, realize that those 9 sgts were getting roughed up pretty good on this forum. Now that the case is resolved they are free to talk now. They've had to keep quiet for three months. They are venting.

 Enough already. You can't ask for an exam to be invalidated and falsely accuse people of cheating, then expect them not to do anything. Money is a non issue for interveners. Petitioners are prob annoyed about having to spend a little more cash, which is why they're fundrasing.

Devil dog...everyone knows that the reason 106 didnt get thrown out was because of the 123 interveners. Additionally, the interveners are all smart guys so they know..as well as everyone else knew that there was no way in hell that the judge was going to toss the list.

So the only logically explanation is that many (not all) of the 123 interveners did not want the list to expand for selfish reasons (i.e., getting jump by a newcomer). The attorney for the 123 interveners even said it himself.

But I'm sure my post will be quickly deleted as censorship appears to be the norm nowadays...again I'm a dog without a fight in this again...and I'm not ondeeair.

Devil dog, don't listen to Ondeair and his fellow trolls, they are just trying to get a rise out of you and are trying to deflect from the fact they gambled with your future in order to make the list. They asked for list to be Invalidated, period. Maybe they should stick to their super secret useless forum, where they can spread lies about bathroom wispers and cell phones. Half the sgts on this job could not stand these guys for the last 4 months and now they are projecting. The Interveners did nothing wrong. I am only glad that a few great guys in the high 60's will now make the list. Feel bad for the guys that will now wait an extra year or two to take the next test.

Thats word for word the language in their complaint. All this stuff is public record, you can not hide from facts.

Devil Dog I haven't read the intervener complaint but there are claims that they were fighting against changes. Can we agree that legal stances aren't necessarily equal to intent? We all need to move on. Be happy you are getting promoted and let the new guys who are making the list be happy as well.

I still laugh how the "Interveners" still STRONGLY claimed they helped with this Settlement and still spew hate towards them. They are a really special delusional group. Theres no arguing the truth. The court transcript of the hearing that took place on June 3 without a doubt proves that they sided with city. This document can be seen in the Slimey 9 Forum. A Forum that doesnt censor facts like this one! Mr Siegel (Intervenors Lawyer) is recorded stating the 106 was fair!!!!!! The fact is that most of the department supported the "Slimey 9" in their fight against the City. If I would have to guess percentage wise, I would say 60% were on their side, 30% just didnt care about this whole situation, and 10% hated and forever will hate them. I think that is what stings them the most. Time to move on! Interveners, take your anger out on the cheaters not the 9 and all their supporters.

The last time I vented in this Forum was to tell onedeeair to shut up. Now everybody has to move on! The few Original Passers have been proven to be full of it. Most of the other original passers are actually a great bunch of guys mislead by these few Haters. At the end of the day the "Slimey 9" did what these Interveners never could of accomplished. That accomplishment is beat the City, change the whole test taking system, and get into the list along with other Happy Sgts. The best argument that these few intervenors have is name calling. Therefore Im glad to be a "Slimer" and I am glad of what they accomplished and along with the majority of this Department, I stand behind them and their Historical accomplishment!!!

By the way. The 9 had a leak. There's an email floating around. In this email they discuss how they have a very good chance at invalidating and getting the list tossed. I'm sure someone will post it.......

We do need to move on. It does leave a bad taste in your mouth when people want to shift the blame to the interveners about 106. It's a settlement all parties agree, we are in a sense all culpable. The fact remains that we wanted an injunction prevented and wanted promotions to resume. We also wanted this not to go to trial because the petitioner's lawyers used case law , were had this not resulted in a settlement and resulted in a win for petitioner's they would have regraded out of less questions than 100. Page 7 of the petitioner's reply to memorandum "moreover, in the event the challenged questions are deleted and the examination regraded some of the 204 sergeants on the eligible list, who correctly answered the challenged questions may either be removed from the eligible list, depending on their scores or be placed in a lower ordinal position after regrading". This would have resulted in some of the original 204 being removed from list and furthermore resulted in less people getting added on. This settlement was the best possible option for the people that are getting added on. I don't think as many people would have made the cut had they regraded out of a 94 or 95, including some of the petitioner's, except maybe the main petitioner. In anycase congrats to everyone. Probably looking at a 350 person list, maybe 3 years exhausted, probably less.

And they also have pictures of your Amici group on how you guys didnt want nobody else to get on the list. This was because of fears of getting bumped down the list. Whats tour point? I have a copy of those emails too and they have atleast 7 of the nine stating they dont want the list tossed! But nobody in your group stepped up and said that they would love to get more sgts on the lost. The point is the interveners arent angels either my friend Diablo

From what I'm told the only reason the jugdge didn't throw out question 106 is she told the city, accept these 5 changes or I'm going to embarrass you and throw out all of them.... At least in this case the city saved a little face and didn't suffer a complete loss (including time and money).  Although the city should've done the right thing from the beginning and realized the tvb tried to f^Ck us

Many of the original passers had a difference of opinion regarding retaining a lawyer, but we all shared ONE common goal, protecting the list. For this reason representation wasnt retained all the way til the end. Some of passers even suggested negotiation with the slimy 9; but most of us would never subscribe due false allegations of cheating. In addition the language in the suit regarding invalidating the list was frightening to say the least. Getting questions tossed wasnt something we were concerned with because ultimately we would benefit anyways. The truth is that the slimy 9 suit began as an all or nothing failed experiment that only took flight because the passers agreed to negotiations. Now they want to take credit for test day changes. I won't take that away from them but those changes would have still occurred, even if they didnt agree to the terms. Most likely the only reason the interveners agree to the terms was because many of them believed the operations orders werent fair and if the scammers were already on the list, why not allow original test date guys to get on. For the slimy 9, dont feel so special, the financial/time hardships of fighting this suit outweigh having a couple questions tossed. The notion interveners were this cult of guys who wanted no one else on the list is delusional.

Don't say  "they" say "us" everyone  knows who u are.No  one is arguing this. The change was definitely long over due. can we, for the love of God, move forward? What's done is done. Let's start counting the days of when this list will come out!!

I don't think anyone is disputing that. I, for one, am glad this was a result.

No one here has mentioned the Sergeants who are still sergeants because of this litigation. And I'm not talking about cheaters either. Looks at the asterisk list and look at numbers 22 - 48. I have met many of those guys and they are great guys that did not deserve to be held up.

I know everyone is going to say that their sacrifice was for the greater good. That may be true, but can anyone blame them for being annoyed about all this? They did everything right and still paid for the city's mistakes. They now have agreed to the settlement and a delay in promotion past this summer.

At this point, regardless of all the drama, it just makes sense to put it all behind us. Everyone had a good reason to be scarred by this job based on this exam. It was a sh*t sandwich for basically everyone.

Windeast ... Nobody disputes that you put the wheels in motion for much needed change and getting many deserving sergeants on the list .i say bravo to your results your a better man than most of us in that regard

However the bottom line is with all the cheating nonsense and the threats of the list being invalidated and never relaying what your intentions were ... Was the list being tossed ??? A curve ?? Oh I know we'll just wait 6 months and see how it plays out ... The guys who passed will let our careers remain in limbo

The intervenors majority intentions was was to to protect the list and avoid further injunctions
I can say I passed a test didn't scam and didn't threaten or use anybody else's careers as ransom

Whats done is done move on already, none of this would of been possible if it wasnt for the 9 and the 124. So i thank both groups since with out them this would of never been possible im one of those lucky Lotto Sgts. So lets talk about how many more made the list, or talk about that poor family in Orlando that poor 2 year old boy.

The interveners agree those questions SHOULD have been tossed. They think that TVB and DCAS SHOULD HAVE tossed them...
The interveners also think that tests SHOULD be on a weekday and the job and DCAS SHOULD limit the number of makeup testers...
But the interveners also think that their promotions SHOULD NOT have been delayed because they didn't do anything wrong. They also think the slimy 9 SHOULD NOT have made cheating allegations against original day passers in order to hold the list for ransom.

 Yes, who knows what tvb was thinking. They recommend zero changes!!  What we are saying is there was zero communication between the 9 and the passers. So we were left to read the complaint. The first complaint did ask for the list to be tossed. The 2nd complaint was acceptable for the most part but legit passers had been screwed out of promotions yet again.  If an article 78 had been sought after from the get go, there would be little to no hard feelings.

Just curious. Who exactly were the 9 supposed to contact? There was lots of talk about getting a lawsuit together on this forum. People contacted Blatt and filed. Then they were bashed. I understand the passers had to deal with a lot of stress and that sucks. But who exactly was Blatt supposed to contact?

I agree my Flambino. Blatt put the info there for anybody that was interested to meet up. Which most the Original 9 did at some secret location which will always be refered as the "The Lot". Everybody was welcomed to join but instead the passers ridiculed them and said it was never going to work. Guess what gal and guys, it WORKED!!! Boy did it work!!!!!

Basically what I am getting from both sides is a lack of communication. Both sides feel that the other should of reached out to the other. My Conclusion is "Interveners" should of just reached out to the 9. The problem is they felt it was over when they passed the test fair and square (which I still give them props). So now like Diablo says lets move on, hold hands and hug each other, its over! Except for Wise Cop, He can go kill himself LMAO
