Me and a couple of my buddies got in touch with a lawyer today in regards to the rumor going around. For those who didnt hear the rumor... The rumor is DCAS only plans to throw out a handful of questions regardless of our protest and make a small list with a test to follow shortly after. Well according the the lawyer he stated that is illegal. Basically if we protest 12 questions. Make valid points on each question DCAS has no choice but to address it. If the 12 questions have double answers or throw outs DCAS HAS TO FIX IT. THEY HAVE NO CHOICE. If for some reason the rumor becomes a reality this lawyer is willing to sue on our behalf. According to him it violates some type of civil service law. He is on stand by to after the throw outs/ doubles are announced. He helped out other civil service employees from different agencies in the past. DCAS would be stupid to not address the questions that deserve their attention. Anybody interested in joining pm me.

They adjusted 15 answers just to make the list bigger for the captains exam. They will do the same for this exam. Don't worry and don't listen to the rumors.
It's great that you have a lawyer. I'm all for it but you just can't get caught up in these unconfirmed rumors when we all know the job will toss questions to make a bigger list. All of a sudden everybody is calling dcas and the reps that answer the phone are giving out opinions of the test and saying they're only throwing out a few questions ? You have to be kidding me if you believe that.
If dcas is saying all this stuff then post the number and extension to the person or office giving this information so we all can ask questions and get this information. Stop believing the things people are making up.
I disgree. I studied my ass off. Didnt see my family. I refuse to let DCAS **** me over twice. Not happening. I will sue the **** outta the city. And you will reap the benefits so you welcome!
I with you as well. They dropped the ball and didn't give us notice on the book they tested us from. A lawsuit will go in our favor if the job doesn't do the right thing.

The problem is, the Final Answer Key is posted when the list is created. So, we all will not have the information as to how many questions will be thrown out/double/triple answered.
VERY TRUE. IF AFTER WE PROTEST THEM TO DEATH IT'S STILL STAND BY AND WAIT AND SEE IF THEY ARE GOING TO DO THE RIGHT THING. 10 TO 15 . FOR US ALL. SMILE
Even if you pick up 10 questions and make the list and you are on the bottom of the list, will it matter? You will still not get promoted! If lets say the 241 unconfirmed passing number is true, if 10-15 questions are challenged the list could go as big as the last Lt's exam, around 1200+. So it will be the same as last test, the top half makes it, the bottom half gets to make the list but will never get promoted.
I don't care about the list size. I care about what's right. I couldn't care less if my name gets called what I care about is taking a fair test and not deal with someones opinion.
I say protest protest protest!!!!!,....screw the lawyer crap,....dont think the lawyer is going to help you get promoted,...besides, who was $10,000.00 + in lawyer & court fees????
Absolutely it will help. city don't want the lawsuit. the only way yo make it right is for us to go to court and have the city defend their choices. I want them to prove what makes their choice the best choice with no reference material to point to, they can't.
Like all of you, I studied my ass off as well. I drove to Nassau early Sat mornings (from SI) for the fast track and to the Key early sunday mornings. I also did Rising Star, used cop cards and anything else I could waste my money on. I was in the top 10 on my '06 sgt exam and when we were all in the first Bmoc class we all got screwed on being allowed to take the Nov' 06 Lt exam by 12 days (we were in bmoc during exam). Since I paid for the exam I sat for it and scored an 84. However, I got weighted "double zeroes" on my score sheet from DCAS- because I technically was still a police officer. Now after this last Bmoc class was given the right to take the last Lt exam (with adjusted scores of 73-75), I was really pissed off. I walked out of that BS, unfair exam wanting to punch a hole in the wall, fearing that I failed. Before seniority pts I scored a 72. With approximately 250 or so passers, that is just dandy. However those of you who received a 67,68 or 69- I really think you will get 3 throwouts or so. Those of you who received a 64 or below (and who studied) I do feel bad, but seriously MOVE ON! DO you really think you and everyone are gonna get 6 or more throwouts and expect to get promoted anyway?? The person with the 64 and who gets 6 throwouts will have the raw score of a 70. That also means everyone who scored the 70 and above will get most of those throwouts as well (especially those who scored bw a 70-75). That means the list will swell to close to 1000 names- and you will never get promoted anyway. Keep in mind the current list was from a 2006 LT exam (5 yrs) and they are only up to 630 or so. Yes I know, Its easier for me to say this, when I passed-I know. But if this exam only has a 350 name list, the list will be done in 2.5 yrs and another exam (straight fwd, exam) will be here in 18 mos.
After the throw outs and double answers are posted, the list will become 700-800 names with a 70 or better. Also, this past Lt exam was not your typical PG exam. The Captain's exam with 15 points added, was in the same league. Expect similar results here, just with more names. It's not about moving on or the list growing to 1000 names. If it does, so be it.
I barely passed. There are people that are smarter than me and also people that studied more than I did that just barely failed. I think we all agree that there were some questions that will be protested successfully and result in double answers and/or throwouts. It is also possible that there are questions that we may think are protestable but we will learn that the slick s.o.b.s that wrote the test beat us with a technicality. It's much easier for me with my tentative score that is on the good side of 70 to say that we have to take this one on the chin but I think that is what we have to do. I know sgts that were born in other countries that passed and I know guys born and raised on long island that failed. Keep your lawyers on stand by if you must but I think the rumors will be proved false.
You guys are just scared people that go in the 60's will pass you. Stop trying to discourage people.
I'm going to try to protest everything that is questionable and hope for the best. I encourage everbody that took the test to do the same. I have friends with scores in the high sixties and I honestly believe most will get promoted. If you pass me because you got a poorly written question wrong that I happened to get right than that is totally fair and you shouldn't have had to deal with the stress of a 68 or a 69 to begin with but if the question holds up you shouldn't sue.
I wish, more people had my mentality. It seems guys just want to give up and do nothing about this. Its plain wrong. Job can not defend these judgement questions. Its as simple as it gets. Yes for these who got them right, i understand you have nothing to gain but to say that they were fair is wrong. Just because someones opinion coincided with yours don't make it right. Obviously i'm not gonna be able to sue on my own, and rely on others for support to pay the bloodsuckers, but i feel there's definitely the case here. I'm done preaching, we'll just have to wait and see what happens.
Good luck proving any of this. If people sue it isn't gonna make them pass. Just delay this list and delay another test from coming out. Now everyone will wait 5 years instead of 2 for a new test. I guess the people who passed are gonna get screwed now. If you didnt make it suck it up and lets start studying for another test a year from now...
Sorry if the list gets "delayed" but im going to do whats right for me! If they throw out a bunch of questions and i dont make it so be it. But im not letting them get away with certain questions not getting thrown out when they had no business putting them on the test to begin with.
