At the very least what should come about from this disaster of a exam, and also the disasters from the recent Captains exam, and the FDNY fiasco is that some form of inter-union/inter city-agency petition amongst uniformed city employees should be drafted to call for protocals to be established in regards to giving proper notice of material to be tested.
I did a google search for a new york state police promotional exam. On the notice of examination they listedseven different types of questions which come from different material ie: penal law, leadership, report writing. What I also saw is that for each of the different testable material they gave a clear and precise example question. Here is the link below for you to take a look.
The difference between the NYS Promotional exam notice, and the cities is like night and day. I don't see no reason why if NYS follows this guideline the city cannot do the same.
In reagrds to a lawsuit, I believe that one should still be established, and I understand that others disagree and respect their opinions. I have spoken to several lawyers and they stated to wait and see how things shake up with the answer key. In regards to our union helping out with any potential lawsuit for the exam they simply will not do it, and I don't blame them. This is because if you have some SBA members on the list how can they fight against a split union populous.
I do however believe that if we presented the idea to our Union about taking the lead on getting a set of established protocals for future testing notices, that they would be interested in helping out. Especially if we got a online petition signed by even only half of the people who took the exam, which is 1000 our union based on the sheer numbers and our power to vote would have no choice but to help out. They could than reach out to the union members of the LBA who are currently looking at another potential disaster of a exam for themselves nest spring.
This petition is something that we could start right now, before the protest session begins. I do believe that there are online petitions somewhere on the internet that can help us with this. We can than set up a few petitions, one for SBA members to present to our union, and perhaps another set that involves all police officers. We can than use the above mentioned reference of the NYS notice as a example of what we would like established for the future.
If anyone has any thoughts in regards to this please let me know. At the very least each of us has a responsiblity to ourselves, and to all our other fellow Union members that the disaster that occured last saturday is never experienced by any of us ever again.
Thank you, FNM for your well-written posting. You brought up a lot of very important issues. I completely agree with you regarding establishing the legal action case. Several sgts I know have spoken to lawyers about this potential case. The common opinion seems to be, just like you've mentioned, that we should wait till the DCAS answer key comes out, and after that-till the appeal process is completed. After that process is completed, we will know exactly what kind of situation we should be challenging.
I think that your idea about doing an inter-unions/ inter-city-agencies petition, the one where we request that the City/ DCAS establish protocols for creating and administering the future promotional tests. I've been talking to many other sgts regarding drafting a petition that all of us who agree on these matters would sign. Your proposal to involve other City employees in this initiative takes it to a much more powerful level. And getting a petition done on-line will certainly expedite this process.
Having the support of all the NYPD unions would be a tremendous help. Hopefully, PBA, SBA and LBA will join forces on this issue, since members of all these unions can only benefit from protocols and"safeguards" that would provide their members with better-written objective knowledge-based promotional tests in the future.
Re: starting a petition on-line. I did a bit of research about it, there are numerous websites for creating internet petitions. Those cites are either unexpensive or completely free and the process of creating such petition seems rather uncomplicated. But what we need to do first is to come to a consensus regarding what we'll want to say in our petition and what exactly we'll be trying to achieve.
