His name is Jeffrey Goldberg he is a civil service lawyer, and he has dealt with these types of issues before. I am including his email at the bottom of this message. He would like to take up our case and says we have a very good case at getting the entire exam dismissed.
I know that a lot of people are hoping to go to the review session and get as many thrown out/double answers as possible, however that does not help a lot of us here who because this was a entirely new exam, was not given the proper time to complete it. Also this is going to waste time for any potential lawsuit where as if we get the ball rolling now, before answer keys/protests start, and before lists are established we might be able to get this thing tossed without very quickly. The lawyer said that he has never seen a exam like this ever occur before, and that he can get it tossed. I haven't spoken to him about finiancial repurcussions, but based on the amount of time all of us have put into this exam, and also the $$ for classes, lost OT opportunities, and vacation days there could be a possible monetary settlement for those apart of the lawsuit.
The lawyer is calling me back tomorrow, and I will be meeting with him later on in the week. I have already had numerous other individuals contact me who want to be apart of this. Also please spread the word around to as many people as possible, and continue to bump up this message. The more people we have for this lawsuit, the less it will cost each of us to hire the lawyer.

Do you realize that having the test completely thrown out screws your peers that actually passed the exam? On what grounds do you want the exam thrown out? Because you didn't know the answers? We all took the same test, we all had the same information as to what test would be like before taking it.
Honestly it's quite possible that I failed, but I gave up quite a few easy ones.
The lawyers that represented fire fighters would be great for this. They should be relatively easy to find.

I agree. And I am not sure how many people did not complete the exam in the allotted 6 hours, but if it wasn't high percentage, there isn't a shot that a case based on that alone, would make it to court. Especially since the Amended NOE listed Time Management as one of the test's topics.
The exam that we took was not the exam that all of us studied for.
I understand what you're saying, but that is historically speaking. The job and/or DCAS never put out a NOE stating that the test(s) would be 95% PG; that is just how it's been done for many years. I think the Amended NOE was DCAS's way of giving the heads up, as well as covering their asses. I'm not trying to piss you off, but I don't want you to spend your money on a long shot.

A few of the Sgts who were in Sept BMOC posted that they didn't get one either. Everyone who filed within the regular filing period was supposedly sent one. Everyone who filed later, I would presume that the NOE they received was the Amended one since it came out in August. If you filed during the regular filing period, I guess you could try and protest that you didn't receive it, though I doubt a handful of test takers taking that stance would be enough to throw out the test.

Do you mean the study materials put out from the PA on the intranet? My guess is that it wouldn't matter since if the PA had a heads up on what was on the exam itself, that would be an integrity issue. Basically, the PA's study materials are just another promotional school except you don't have to pay for it.
I agree with smartcookie this test isn't getting thrown out. I think our best bet is to get as many people as possible to protest most of these questions. I personally did well on this exam referring to the inbasket and PG portion (Don't know how the judgement questions will be graded) and I'm still attending the protest session.

This test was bull**** but not for nothing, i got around a 68-70 with all these lists and yet I do remember dropping around 5 or 6 easy ones. No one forced me to take this test. I do agree that there were around 20-25 questions that were either double answers or just ****ty questions that should be thrown out.
I dont believe that DCAS supposedly sending a revised NOE in August which a lot of people didn't receive and was halfway between the cutoff date to register for the exam and the exam date is enough to cover them.
The initial NOE which we all signed up for in June did not have this information, and than halfway thru they send a garbage piece of paper thru mail which a lot of people didnt receive and that covers them??
What right do they have to change the majority of the test halfway thru the signup cutoff date?? Once the cutoff date for the exam is established that's it. No changes should be allowed.
If I go to sign up for the exam, and the rules for the exam are there for me to look at before I sign up, and I agree to sign up for the exam at that time, than at a later date DCAS decides to change it, than in order to make sure that everybody is aware of this change than that letter should be sent by certified mail. If not than that by itself is grounds for a lawsuit. You do not change the rules of the game halfway thru the race.

I think when the tentative answer key comes out on d 28th many people will be surprised at how close they'll be to passing. Protest Protest Protest. My prediction less than 500 will originally pass but with throwouts/double answers approximately 800/900.
The filing date for the exam was July 6, 2011 thru July 26, 2011. The amended NOE was released on August 3, 2011. If you took the Fast Track, Mike sent an email to all of the students on August 8, 2011, specifically addressing the revision.
