Update on SBA grievance pertaining to Sergeants promoted after April 1, 2006

The SBA filed a grievance against the Department as soon as the PBA arbitration award was rendered and analyzed in the summer of 2008 on behalf of all sergeants who were promoted after April 1, 2006. It is our position that those sergeants are not being paid at the correct salary step because of the effects of the PBA award.

In accordance with our collective bargaining agreement, we initiated the grievance procedure at Step III, by filing with the Informal Grievance Board through the Departments Office of Labor Policy. It was the position of the Office of Labor Policy that there was no violation, misinterpretation or misapplication of the rules or procedures of the Department nor was there any violation, misinterpretation or misapplication of the current collective bargaining agreement.

Once we received this decision we proceeded to Step IV by filing an appeal with Police Commissioner Kelly. The Commissioner denied our appeal and concurred with the decision of the Informal Grievance Board.

Immediately upon receiving notice that the Commissioner had denied our appeal, we moved to Step V by filing a motion with the New York City Office of Collective Bargaining and requested an impartial arbiter to hear our case. We currently are in the process of selecting an impartial arbiter.

This issue is of paramount importance to the entire board of the SBA and we are doing everything possible to ensure that our members are treated fairly and respectfully. Don't hold your breathe on a payscale adjustment. Ask any Sba delegate and they will tell you the same.

I agree. I wouldn't be surprised if this doesn't change until a new SBA contract I believe 2011. They'll just have the new Sgt. s suck it up for 2 years.

what makes you think there will be a new contract in 2011?  You dont think the city wont cry poverty for the next few years even if the economy improved, i'm sure the pba and the sba will end up going with arbitration, taking endless months to get a new crappy contract.  And the grievance is a waste of time, by the time an arbiter is chosen, IF it happens that quickly, those of us who hit the second step by 8/1/09 will be making the same as a top pay cop and third step sgt's will be making 500 more than a top pay cop, and by 8/1/10 a newly promoted sgt will be making more than a top pay cop.  I'd rather wait a couple of months and wait to hit the second step, its better than having the sba waste my union dues on the grievance that will solve nothing by the time it actually does gets resolved.
