TITUS, tell your LT we thank him for the information. I think he got the date wrong though. Not a problem. If he feels bad about about the misinformation he can make it up to us by letting us know what questions are now double answers.....etc......like question 95 A or C and question 59 A or D etc.
The list will come out the week of the 14th to the 19th and the class in there now will be promoted on the 26th!
I also heard someone was sent back to their command from bmoc, because the person did not have all of her education information together; so ppl check your college credits info please.
if the list doesn't come out before sept. 26 everybody from bmoc including myself will be sent back to their commands w/o getting made! I don't see how this is possibly but that's what was said.a guest speaker who was a lt also said that this is a first time he's ever seen a class go into bmoc w/o an active list.

I was told that this situation hapened twice in I past. if it happened before it can happen again!
JAGGEDJ, DO YOU THINK THIS JOB CARES ABOUT THOSE 20 COPS THAT ARE LEFT. LAWSUITS? I WAS CUT OFF FROM THE LIST A COUPLE OF YEARS AGO, WE STARTED A LAWSUIT AND WE GOT NOTHING!! ANYTHING CAN HAPPEN, WE JUST HAVE TO WAIT AND SEE; YOU KNOW HOW IT GOES ON THIS JOB.
I know Tito but this is what's going on. we are all sitting in ours chairs in bmoc not knowing if we r getting promoted. all the instructors and guest speakers r cracking jokes how we don't have lists numbers. the whole not knowing phase is killing me and I'm sure everyone else. especially knowing that we might very well get screwed!!!
TITO..... Important question...were u cut off because they never made it to ur list number ?? or because they skipped over u for lack of time, then never promoted u...There is a big difference...Please let me know

dude, i have news for you. As far as the guys waiting for five years it doesn't mean jack what they got on the test or what their list number is. When their number was up they were NOT ELIGIBLE for promotion. The job is not obligated to wait for them to get eligible. Lets say you get 100 on the test but you only have 50 college credits. Should they wait for you to finish school and hold up all future promotions until you do?
sorry to break it to ya but u r wrong.getting passed up cuz u don't have enough credits is totally different from getting passed over for lack of time. not having enough credits is the cops fault but lack of time isn't.it doesnt make sense for the job to let ppl with 3 yrs on take the test if they don't keep the list active for 2 yrs!
J i usually agree with you, but from what I gathered was if the list comes out and someone who had a list number before you got passed over for, lets say credits, and he got that straightend out during the 2 weeks you were in bmoc, he would be promoted over you and you would get sent back to your command and promoted with the next class. The guy who scored in the top 30 is not getting sent back and not promoted. That was for the 80-81 guys who are in the class ahead of guys that got passed over bs. Not everyone is going to be sent back after this month if there is no list. Although, I was wrong many, many times on the test so I could be wrong here too, but thats just what I got out of it.

I spoke to the sgt privately n she said the list needs to b established before we get promoted cuz we need a list #. if the list doesn't come out then we go back. that's what she said but at the same time she said she doesn't have experience in situations like this either so who knows.
The authority of the PC is enormous in matters of promotion. I understand that civil service law mandates certian criteria for promotion. However, the PC can supercede civil law when he is acting in good faith in response to the needs of the Department and public safety. Promoting off of two lists concurrently and being passed over when it is the cop's fault has been done. What has not been done in the past is being passed over when it is not the cop's fault. I cannot believe in all fairness that the PC will allow cop's who earnestly studied and passed, obtained a good score to now allow them to be passed over and then kill their list. These cop's that don't have enough time would be short just a few months, If I'm not mistaken? What kind of leadership message does that send to the rank and file. Ladies and Gentleman if this is the case, then this job is worse then what we can ever imagine.
Someone who does not have 5 years OTJ knew they would not be promoted until they do. They are not qualified for the promotion until they do. It is in the NOE and therefore there will be no lawsuit.
The NOE says for eligibility is " has served as a permanent employee in such title in the New York City Police Department for a period totaling three years preceding that date. The NOE does say you need atleast five years to be promoted. But what it doesn't state is that if they pass your list # because of lack of time you wouldn't be promoted. I could be wrong but I didn't read anything about that. For all we know the cop whose list number is # 1 might not have enough time on the job to get promoted until 2010. Who knows how many cops were passed over. If the job is not going to promote those cops, me included; they should change the eligibility to take the test to 4 or even 5 years on the job to avoid this ridiculous situation.
Duration The Civil Service Law provides that the duration of an eligible list shall be not less than one year nor more than four years. If a list has been in existence for one year or more, it shall terminate upon the establishment of an appropriate new list unless the old list is extended by action of the Department of Civil Service. Additionally, should a financial emergency restrict the filling of vacancies, the Department of Civil Service may, in its discretion, extend the duration of the list for a period equivalent to the length of the restriction. Once a list expires, it cannot be revived, nor can an individual whose name was on the expired list receive an appointment on that basis.

i agree...u shouldnt be allowed to take the test unless u have 4 yrs on...also, good info...to me that sounds like there can be 2 active lists at once...civil service law can extend the old one and have 2 lists running
If you get passed over for WHATEVER REASON.(ncluding lack of time which makes you ineligible for promotion) and the list has been active for one year, they can kill the list period!!! They are absolutely not obligated to wait for people to meet all the requirements for promotion...got that jagged?
i heard similar news that the list would come out by the end of the month. i posted a while back that i figured this cheap city would probably wait until after the filing for the new test just to squeeze out some extra money from guys that need one or two of the throw outs/double answers like myself. Unbelievable that they would do that but i can't think of any other reason to wait until the end of the month.

Jose, Knice highlighted it right there ...What that spells out is that 2 lists can actually be active at once....The current list CAN be extended by action of the Department of civil service.
