So the union picks which Sergeants to assist in this debacle instead of just remaining neutral? They chose to defend 76 cheaters vs 2400 honest sgts. Amazing. Just goes to show you that the union's job is to protect the city from lawsuits. They could care less about us. Anyone that goes to the trial room with an SBA attorney is out of their mind.

The president of the Sergeants Benevolent Association downplayed what the New York Post called a potential cheating scandal involving SBA members who took a makeup promotional test for Lieutenant last year.
Its inappropriate to look at this as possible cheating, SBA President Edward D. Mullins said in an interview Feb. 25. This is a flaw in the system.
Second Time the Charm
Cathy Hanson, a spokeswoman for the Department of Citywide Administrative Services, which administers civil-service tests, said that 164 of 2,401 Sergeants who took the Lieutenants exam passed it when it was first offered April 18, 2015.
In contrast, she said that 40 of the 83 who took the makeup exam passed. The civil-service list from the two exams had 204 names. She said DCAS could not comment further.
Critics charge that some Sergeants may have gamed the system by taking the make-up exam months after the same test was first givena window that could have let the candidates get the correct answers from the original test-takers, the Post reported Feb. 24.
Mr. Mullins said the problem was that the makeup test was held about a month after the regular test date, which was Saturday, April 18, 2015. The two tests were exactly the same except for a change in the order of the questions, he said.

After a test is given, he said, people at work are talking about it. How do you keep people who havent taken it yet from listening to the conversations?
Louis Turco, president of the Lieutenants Benevolent Association, noted that some test-takers are excused from Saturday tests because of religious observance.
He suggested scheduling the regular test for Saturday and the makeup test for the Thursday or Friday before. You cant take away military or sick [excusals] but you can take away the religious component, he said in an interview.
Sergeant Mullins said he agreed with Lieutenant Turcos proposal.
The LBA leader said that if the numbers reported in the Post were correct, it seems like people got an unfair advantage by taking the makeup test.
Low Initial Success Rankles
He said he was disturbed not only by the disparity in passing rates between the April 18 test and the makeup test, but also by the low number of people who passed the initial test.
I dont know whether this is an aberration, but you cant have numbers like this, he said.
The NYPD is aware of certain issues that have been raised concerning the 2015 Lieutenant promotional make-up exam, NYPD spokesman Stephen Davis told the Post. We have been in contact with DCAS and are reviewing these issues.

A flaw in the system, a loophole, cheating the system... Call it what you want but when enough noise is made things get investigated.
