I spoke to Michelle today who was our lawyer.If you remember, the judge refused to grant an injunction but told us we could refile the complaint once the list came out.Our argument was that test #1534 was arbitrary and capricious.But this week Michele talked with lawyers from DCAS who told her that a total of only seven questions would require answer key adjustments.(No, I dont know how many were throwouts vs. double answers, which questions are changing, and DCAS has no idea what the release date is.)Michele told us that if only 7 questions require adjustment, it is hard to argue that the test was arbitrary and capricious.She said she did not advise us to proceed any further, though we could if we wanted to pay more.There is no interest, including from myself, in paying any more money.So thats it. Case closed.No more lawsuit.The only word of encouragement we got was from a DCAS lawyer who told Michele Tell your clients not to be too upset.This list will be shorter- less than 700 people- and there will be another test in three years or so.But this does little good for me.I have 14 years on now and by that time it will not be worth studying again.
I got a 58 and I am not getting promoted.I got excited because DCAS wanted my proof for my veterans credit, but that means nothing.The names for veterans credit were apparently chosen before the review process was even over.I have now studied hard for two Lts tests, and will never be promoted.In the end, this is partially my fault.I spent six years in the Marines because my parents, who left PR for the Bronx when I was 15, did not have money for me to go to college.I did not have the grades either.I had the veterans credit on the 2006 test and did not use it because I though for sure I would get promoted and wanted to save it for the captains test.Had I filed for the credit in 2006, I would been promoted by now.Instead I died on the list and I will retire a sergeant.This is not the worst thing in the world considering my father and mother never made more than 10 dollars an hour in their life, but it hurts working so hard and coming so close, only to fail now.At least the whole process forced me to go back to school and get a degree, which is something good.
I know many of you people were upset about the lawsuit, but I hope you also understand what this whole dumb process put us through.I am done with promotional tests.I just want to wish you all luck.I really do wish you all the best.

Well written post and I'm sorry things didn't work out for you. I have to ask though....and I'm not trying to throw salt on your open wounds....But why save your vet pts for a Capt's test when that is essentially a pass fail exam? No one signs up, and only a 100 or so pass. With the competitive nature of a Lt's exam, that is the test to use it on. Just don't understand what your logic was there.

Whether you're a "troll" or not, I have one question for you. Why would you defer your veteran's credit for a captain's exam??? Most people take the rank of sergeant with the mindset of becoming a lieutenant one day. Once you reach the coveted rank of lieutenant, now you have options as far as your career goes BUT to be that confident that you would be promoted and not die on a list is absolutely mind boggling.

No lawyer is going to say no to 20 people throwing their money away, that's the first clue. Secondly this guy posted he had his vet interview on the 30th. When today is the last day. It's gonna be a small list of 700 and will go fast with only 7 changes gimme a break. Last list went full 4 years and reached 755.

I hope this post is true. I do find it hard to believe. I do not think that 7 throwouts would boost the list to 700. Just find it kind of weird that it is 7 throwouts and alot of people are posting that they got 60-63. Then he says that even though he got a letter it does not mean he passed they are just sending it to everyone " The names for veterans credit were apparently chosen before the review process was even over. " It seems A little strange to me. Take this post with a grain of salt.

I really messed up. Based on the way things went between 1998 and 2005, I thought I would be promoted to LT within three years. It used to be the captains list that went really slow, and having extra points could make the difference of years.

I know for a fact that there are over 15 changes made to this exam. Don't believe this fool for one second. You have guys with a 60 getting the veterans letter so he should have made up a better lie. Good try.

I tell ya, the shyte that gets written about this exam is astounding. Let me just say this: Not even the Chief of Dept. knows right now when the list is coming down, and if he does it will be right before we all know. This whole exam is wrapped in delusions and misinfo all around.
