I think the more important question for us is if it is confirmed that they MUST have a list established. The old.list is dead in less than two Weeks.

From my personal experience I've never seen at least one list not be active.

From my reading of NYS Civil Service law, and I am not a lawyer, I believe that they do NOT have to have an active list.
They are of course prohibited from having two active lists. On the other hand, assuming that the '06 list is not extended, given that the '11 list will be small even with some throwouts, and given the schedule of the protest review, I think it is likely that they will establish a list very shortly. On yet a third hand, like a lot of posts here, maybe this is just wishful thinking. The waiting is killing me.

I oversimplified. The establishment of a new list automatically terminates the old list unless the old one is extended.
"If a list has been in existence for one year or more, it shall terminate upon the establishment of an appropriate new list unless the old list is extended by action of the Department of Civil Service."

He is definitely right about the two list, while two can be established they can only be hiring off one. They can combine the two lists however one list must be very small. Not the case with either of these lists.

approx 25 LTs were promoted a month ago .....and 42 expected to go in bmoc shortly....then that suppose to be the end of the 2006 Lt list...thats why they are trying to protest. including the 42....it will be 750 out of 1200 promoted....they test was very fair and straight forward.....no where as crazy as ours. the sgts who will not be promoted cant be so mad. last i heard from a sgt in bmoc now (cop about to be sgt)...he claim they said it will be 12 throw outs including double answers. fingers crossed

"issuing exams that are not related to our job description" yes, sometimes you have to think outside the box (patrol guide) to make a decision in the real world. So when the judge asks you to produce your job description you will show him...???
