29. Discuss the circumstances of the stop with the member of the service and review the STOP REPORT.
a.Determine whether all captions are completed and all relevant check boxes are checked.
b.Confirm that the STOP REPORT states in plain language a specific suspected felony or Penal Law misdemeanor.
c.Determine whether the officers description in the Narrative (Describe the Circumstances That Led to the Stop) caption includes the facts and circumstances relied upon by the officer to conclude that there was reasonable suspicion that the person stopped had committed, was committing, or was about to commit a felony or Penal Law misdemeanor.
d.If the person was frisked, determine whether the officers description in the Narrative (Describe the Circumstances That Led to the Frisk and/or Search, if Conducted. Include Area Searched) caption includes the facts and circumstances relied upon by the officer to conclude that there was reasonable suspicion that the person was armed and dangerous and, if a search was conducted, the facts and circumstances that provided the basis for the search, the area searched and whether a weapon or other contraband was recovered.
e.Complete the Supervisory Action (Must Complete) caption. Consider the facts and information as conveyed by the member and recorded on the STOP REPORT and in the members ACTIVITY LOG and determine whether:
(1) The stop was based upon reasonable suspicion of a felony or Penal Law misdemeanor
(2) If the person was frisked, whether the frisk was supported by a reasonable suspicion that the person was armed and dangerous; and
(3) If the person was searched, whether there was a sufficient basis for the search.
f.If appropriate, instruct member of the service and/or refer for additional training and/or other remedial action, including, disciplinary action and indicate such in the Follow-Up Action (If appropriate) caption.
g.Direct the member to make necessary corrections to the STOP REPORT if the report is inaccurate or incomplete.
Complete and sign the STOP REPORT.
Immediately before signing the stop report you have to direct him to make necessary corrections if the report is in accurate or incomplete which clearly was not done since the stop report was wrong so he should not have signed it yet in my opinion

Does anyone remember what the first scenario was for the stop report?
I. ????
II. A frisk would not be warranted
III. The supervisor should not have signed the reoort
IV. The report was prepared correctly
anyone remember I?

I agree with what you're saying. However, the question wasnt what is the NEXT STEP, so signing the stop report isn't a wrong answer, if it was what is the NEXT step theN that argument would hold true. I don't know man I'm just looking at what's black and white on paper hoping I can buy a white shirt and butter bars just like the rest of you.

How is saying "a frisk would not be warranted" wrong? It isn't warranted. Doesn't matter if the box was checked or not.. A frisk wasn't warranted

I agree with you on this point. But warranted or not, you still fill out a 250 and that 250 still gets signed. As a boss you would note it that the cop f-ed up or needs re training or further instruction and you sign.

Right, but none of that was noted. The supervisor himself didn't properly complete his portion of the Stop Report, therefore signing it was no good (line H says "Complete and sign"). Also, is a Platoon Commander a "unit supervisor"? I'd wager he/she is not.
This is a tough one and we'll never know for until the protest because so much of this is dependent on what was going on in the writers' minds, and where they intended to go with it.

It's agreed upon that it was wrong. The debate is whether the answer was "Only II" or "Both II & III".

1) Anonymous tip/gun run
2) Bystander filming
3) I do vaguely remember seeing another, but I could be wrong. I think it may have been mixed in/tied with a PG procedure, or it was the other Stop Report question (show-up with negative results was the right answer, and the forcible Level 2 stop was wrong).
