 I guarantee that penal law question won't be changed. It was a cheap shot in my opinion but it was very well written for it's purpose.

There are no less than five attorneys contacted, some I've spoken to personally, they all concur that the legislative intent of the "correct" answer is completely wrong. Additionally, there are only three sections in the penal law that could apply and two of them were not choices.
